<br />STAl'!: OF TEXAS <br />COUNTY OF HAYS <br /> <br />I <br />I <br /> <br />CONTRACT <br /> <br />KNOW ALL MEN BY T!lESE PRESENTS: <br />That on this day of October A.D., 1977, the City of San ~larcos, <br /> <br />I Hays County, Texas, a municipal corporation existing by and under <br />the 1 ai,S of the State of Texas, hereinafter referred to as !lei ty" :1 <br /> and Worthington Enterprises, Inc. . hereinafter referred to as <br /> <br />"Contractor" a firm doing business in Seguin, Texas, ,entered into <br /> <br /> <br />this agreement for construction of a T-Hangar structure at San, <br /> <br /> <br />Marcos Municipal Airport located at Camp Gary, Caldwell County, <br /> <br /> <br />Texas; the terms and consideration of said agreement being as <br /> <br /> <br />f 011 O\VS : <br /> <br />I <br /> <br />I. <br />Contractor agrees to construct a single structure, nine (9) unit, <br />prefabricated, all metal, painted ai rcraft "nested T-Hangar" in <br />accordance \Vith the particular specifications attach~d hereto as <br /> <br /> <br />Exhibit A, said specifications being incorporated herein for all <br /> <br /> <br />intents and purposes as a part of this contract; said structure to <br /> <br /> <br />be located by "Contractor" on the San Marcos ~lunicipal Airport, <br /> <br /> <br />at Camp Gary, Cald\Vell County, Texas, in accordance \Vith thi 5i lc <br /> <br /> <br />plan attached hereto as Exhibit il, said site plan being incorporated <br /> <br /> <br />herein for all intents and purposes as a part of this contract. <br /> <br /> <br />II. <br /> <br /> <br />Contractor agrees to commence work under this contract on or beforp <br /> <br /> <br />the 3rd day of October, A.D., 1977, and to fully complete the pro- <br />ject \Vi thin 120 consecutive calenllar days thereafter as stipul;ILGd <br />in exhibits A and B attached hereto; provided ho\Vever, that bad <br />\Veather dais, as determined by both parties shall not be counted <br />toward completion time of this contract. Contractor further <br />agrees to pay as l.iquidated damages, the amount of $50,00 for each <br />consecutive calendar day beyond the 120 day period allotted above <br />for construction, that the project is not completed, Contractor <br />agrees that timely completion of this project is of importance to <br />the City and that City shall be entitled to \Vithhold said liquidated <br />damages from the final payment to the Contractor. <br /> <br />I <br />
