167 ORDINANCE NO. 1977 - 45 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AND ADOPTING AMENDMENT NO. 5 TO THE URBAN RENEWAL PLAN FOR N.D.P. PROJECT TEX. A-6, DIRECTING THAT SAID CHANGE BE FILED AS PART OF THE URBAN RENEWAL PLAN FOR SAID PROJECT, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City has adopted a Redevelopment Plan known as the Urban Renewal Plan for N.D.P. Project Tex. A-6, Final Action Year; and, WHEREAS, Amendment No. 5 to said Plan has been proposed for the purpose of effectuating a change in land use for that certain tract described in Exhibit "B" attached hereto, and made a part hereof, said certain tract being within the boundary of the Tex. A-6, Neighborhood Development Program area, from "Public" use to "Commer- cial" use as defined by said Plan; and, WHEREAS, said Amendment No. 5 has been submitted to and approved by the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas, by Resolution dated July 5, 1977; and, WHEREAS, in addition, said Amendment No. 5 has been submitted to.the Planning and Zoning Commission of the City of San Marcos and received its favorable recommendation and said recommendation has been forwarded to this body; and, WHEREAS, said Plan, as amended, will conform to the general plan for redevelopment of the City as a whole; and, WHEREAS, the provisions of the Texas Urban Renewal Law, Article 1269L-3, Section 7e of the Vernon's Annotated Civil Statutes of Texas regarding modifications in Urban Renewal plans have been complied with. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, THAT: SECTION 1. Amendment No. 5, consisting of one page of text, Land Use Map 3AAA (attached hereto as Exhibit "All), and an accompanying survey (as Exhibit "B"), which changes the land use for a certain parcel of land, as described thereon, from "Public" use to "Commercial" use as part of the Urban Renewal Plan for the Tex. A-6, N.D.P., is hereby ratified, adopted and approved. SECTION 2. Amendment No. 5 is attached hereto and made. a part hereof. SECTION 3. The City Secretary is hereby directed to maintain a copy of said Amendment No. 5 on file in her records as public notice of the change in the Redevelopment Plan for N.D.P. Project Tex. A-6, Final Action Year, and said Amend- ment shall be binding on all redevelopers within the said project area. SECTION 4. This Ordinance shall become effective on the 11th day following the date of due legal process and publi- cation in a newspaper of general circulation in the area.
