I <br /> <br />EXHIBIT "A" <br /> <br />. <br /> <br />STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />CONTRACT FOR SERVICES <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, a Municipal Corporation, <br />existing by and under the laws of the State of Texas, acting by and <br />through its Mayor, Frank T. Arredondo, and the San Marcos Chamber of <br />Commerce enter into this agreement pursuant to the terms and pro- <br />visions of Chapter 26, Article II of the Code of Ordinances for the <br />City of San Marcos, Texas. <br /> <br />WITNESSETH <br /> <br />I. <br /> <br />The City of San Marcos has enacted by ordinance a Hotel Room <br />Occupancy Tax to be levied upon the occupancy of any room furnished <br />by any hotel within such City. Pursuant to Section 26-21, flUse of <br />Proceeds,fI the City does hereby agree to allocate funds from the <br />revenue of said tax to the San Marcos Chamber of Commerce. The allo- <br />cation of funds to said Chamber is hereby agreed to be ninety percent <br />(90%) of the gross of all funds collected from the Hotel Room Occupancy <br />Tax. Furthermore, it is expressly agreed that the Chamber shall be <br />entitled to operating and administrative expenses not exceeding fifteen I <br />percent (15%) of the total allocation of such funds collected fr'om the <br />Hotel Room Occupancy Tax to be received by said Chamber. <br /> <br />II. <br /> <br />I <br /> <br />The San Marcos Chamber of Commerce does hereby agree to expend <br />said funds for the uses of proceeds set out in Section 26-21 of the <br />ordinance, including advertising for general promotional and tourist <br />advertising of the City and its vicinity, and conducting a solicita- <br />tion and operating program to attract conventions and visitors -to the <br />City. The Chamber of Commerce further agrees to submit a semi-annual <br />budget to said City requesting funds available from the revenue of <br />said tax. Such budget presentations shall include a report of acti- <br />vities and expenditures from previously allocated funds. <br /> <br />III. <br /> <br />It is hereby agreed that a tourist development committee shall be <br />formed to serve as an advisory committee to said Chamber and no funds <br />allocated from said tax shall be expended without the advice and con- <br />sent of said committee. The membership of the committee is agreed <br />to be five (5) persons who shall serve for the duration of this agree- <br />ment. It is specifically agreed between the parties hereto that two <br />(2) members shall be appointed by the City Council of said City, and <br />two (2) members shall be appointed by the Board of Directors of said <br />Chamber. The fifth member shall be selected by the four (4) appointees I <br />The City Manager of said City and the Manager of said Chamber shall be <br />ex-officio members of the Committee. <br /> <br />IV. <br /> <br />I <br /> <br />It is hereby further agreed that a subcommittee for the arts of <br />the tourist development committee shall be formed to serve as an ad- <br />visory committee to the Chamber on the expenditure of funds to be <br />allocated under Section 26-21(a), 26-21(f) and 26-21(g) of the ordi- <br />nance. The membership of the sub-committee is agreed to be composed <br />of three (3) persons who shall serve for the term of this agreement, <br />with two (2) of said members to be appointed by the City Council, <br />and one (1) member by the Board of Directors of the Chamber. <br /> <br />V. <br /> <br />The City Council specifically stipulates and the Chamber hereby <br />agrees that no less than Seven Thousand Dollars ($7,000.00) of the <br />annual Hotel Room Occupancy Tax must be allocated to those use:, of <br />proceeds s~t out in Sections 26-21(a), 26-21(f), and 26-21(g) of the <br />Ordinance. <br />
