<br />188 <br /> <br />ORDINANCE NO. 1977 - 49 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE PRICE AND CONDITIONS OF <br />THE SALE BY THE CITY OF SAN MARCOS, TEXAS, OF PART OF <br />PARCEL NO. 10-11, DESCRIBED FURTHER ON EXHIBIT flAfI ATTACHED <br />HERETO, LOCATED WITHIN THE TEX. A-6, NEIGHBORHOOD <br />DEVELOPMENT PROGRAM AREA, TO P. KENNETH PITZER, TRUSTEE; <br />AND AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY DEED TO <br />P. KENNETH PITZER; AND DECLARING AN EMERGENCY. <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos, Texas, advertised for bids for the sale <br />of that certain real property known as part of Parcel 10-1, and described, <br />more fully as 1. 280 acres in the Katy Addition on Exhibit "AfI attached <br />hereto, located within the Tex. A-6, Neighborhood Development Program <br />area, in the San Marcos Record, a local newspaper with a general circu- <br />lation within the County of Hays, State of Texas; and <br /> <br />WHEREAS, pursuant to said advertisement a bid was submitted by P. Kennethl <br />Pitzer for said part of Parcel No. 10-1; and <br /> <br />WHEREAS, the said bid met the minimum disposition price set upon said <br />property by the Board of Commissioners of the Urban Renewal Agency of <br />the City of San Marcos, Texas; and <br /> <br />WHEREAS, the said Board accepted the bid as the highest and best respon- <br />sible bid for said property by a motion duly passed on November 8, 1977, <br />after the bid opening of November 8, 1977; and <br /> <br />WHEREAS, said motion also approved the terms and conditions for the sale <br />of the said property and recommended the approval of said purchase price <br />and the approval of the terms and conditions for the sale, as contained <br />in the bid documents, by the City Council of the City of San Marcos, <br />Texas; and <br /> <br />I <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in said bid <br />and the sales terms and conditions pertinent thereto conform to -the <br />Redevelopment Plan for the development of the City as a whole; now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That the terms and conditions of the sale by the City of <br />San Marcos, Texas, of part of Parcel No. 10-1 within the Tex. A-6, <br />Neighborhood Development Program area, and more fully described as <br />1. 280 acres in the Katy Addition on Exhibit "AfI attached hereto to <br />P. Kenneth Pitzer, Trustee, are hereby approved. <br /> <br />Section 2. That the consideration for the sale for said property being <br />$61,332.48 for 55,756.80 square feet is hereby approved. <br /> <br />Section 3. That the sale by the City of San Marcos is made subject to <br />restrictions of the Redevelopment Plan for the Tex. A-6, Neighborhood <br />Development Program, as approved and amended, said plan is on file and <br />is, available for inspection in the Office of the Director of Community <br />Development of the City of San Marcos. <br /> <br />I <br /> <br />Section 4. That the conditions of the disposition documents, including <br />the Deed and Contract for Sale for Private Redevelopment, are on file <br />and are available for inspection in the Office of the Director of <br />Community Development of the City of San Marcos. <br /> <br />Section 5. That the purchaser is hereby placed on notice that the <br />subject property is subject to assessment under the provisions of <br />Article 1105b of the Revised Civil Statutes of the State of Texas. <br /> <br />Section 6. That the Mayor of the City cjf San Marcos is hereby c_uthorize' <br />to execute a warranty deed to P. Kenneth Pitzer, Trustee, from the City <br />of San Marcos, for all that real property known as part of Parcel No. 101 <br />located within the Tex. A-6, Neighborhood Development Program, and <br />described more fully as 1. 280 acres in the Katy Addition on Exhibit "AfI <br />attached hereto. <br />
