<br />I <br /> <br />I <br /> <br />I <br /> <br />221 <br /> <br />on the part of the City of San Marcos or any officer,or employee <br />thereof for any flood damages that result from reliance on this Article <br />or any administrative decision lawfully made thereunder. <br /> <br />Section 5-51. DESIGNATION OF FLOOD DAMAGE PREVENTION ADMINISTRATOR <br /> <br />The City Manager, or his designee, is hereby appointed to administer <br />and implement the provisions of this Article. <br /> <br />Section 5-52. <br /> <br />DUTIES AND RESPONSIBILITIES OF THE <br />FLOOD DAMAGE PREVENTION ADMINISTRATOR <br /> <br />Duties and responsibilities of the Flood Damage Prevention Administrator,! <br />hereinafter referred to as Administrator, include, but not be limited <br />to, the following: <br /> <br />a. Maintain and hold open for public inspection all records per- <br />taining to the provisions of this Article; <br /> <br />b. Review, approve or deny all applications for development per- <br />mits required by Section 5-46 of this Article; <br /> <br />" <br /> <br />c. Review permits for proposed development to assure that all <br />necessary permits have been obtained from those Federal, <br />State or local governmental agencies from which prior approval <br />is required; <br /> <br />d. Where interpretation is needed as to the exact location of the <br />boundaries of the areas of special flood hazards (for example, <br />where there appears to be a conflict between a mapped boundary <br />and actual field conditions) the Administrator shall make the <br />necessary interpretation. <br /> <br />e. Notify adjacent communities and the Texas Department of Water <br />Resources prior to any alteration or relocation of a water- <br />course, and submit evidence of such notification to the Federal I <br />Insurance Administration; <br /> <br />f. Assure that maintenance is provided within,the altered or <br />relocated portion of said watercourse so that the flood <br />carrying capacity is not diminished. <br /> <br />g. When base flood elevation data has not been provided in accor- <br />dance with Section 5-45, the Administrator shall obtain review" <br />and reasonably utilize any base flood elevation data avail- <br />able from a Federal, State or other source, in order tc ad- <br />minister the provision of this Article. <br /> <br />h. Until a regulatory floodway is designated, no new construction" <br />substantial improvements, or other development (including <br />fill) shall be permitted within Zones Al-30 on the City's <br />FIRM, unless it is demonstrated that the cumulative effect <br />of the proposed development, when combined with all other <br />existing and anticipated development, to/ill not increase the <br />water surface elevation of the base flood more than one foot <br />at any point within the corporate limits of the City. <br /> <br />Section 5-53. <br /> <br />PERMIT PROCEDURES <br /> <br />a. Application for a Development Permit shaLl be presented to the <br />Administrator on forms furnished by him and may include, but <br />not be limited to, plans in duplicate drawn to scal~ showing <br />the location, dimensions, and elevation of proposed landscape <br />alterations, existing and proposed structures, and the locatior <br />of the foregoing in relation to areas of special flood hazard. <br />Additionally, the following information is required: <br /> <br />1. Elevation in relation to mean sea level, of the lmvest flo <br />(including basement) of all proposed structures; <br /> <br />2. Elevation in relation to mean sea level to which any non- <br />residential structure shall be floodproofed; <br /> <br />3. A certificate from a registered professional engineer or <br />architect that the non-residential floodproofed structure <br />
