ORDINANCE NO. 2010 -20 <br />• <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "VLDR" VERY LOW DENSITY <br />RESIDENTIAL TO "MU" MIXED USE FOR A.07 ACRE, MORE OR <br />LESS, TRACT OF LAND OUT OF THE THOMAS J. CHAMBERS <br />SURVEY ABSTRACT NO. 2; AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING THIS TRACT FROM "FD" <br />FUTURE DEVELOPMENT DISTRICT TO "MU" MIXED USE <br />DISTRICT; AND INCLUDING PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On December 8, 2009 and April 13, 2010, the Planning and Zoning Commission of <br />the City of San Marcos held public hearings regarding a request to change the Future Land Use <br />Map of the San Marcos Horizons City Master Plan from "VLDR" Very Low Density Residential <br />to "MU" Mixed Use, and a concurrent request to change the zoning from "FD" Future <br />Development District to "MU" Mixed Use District, for a .07 acre, more or less, tract of land out <br />of the Thomas J. Chambers Survey Abstract No. 2. <br />2. Subsequent to the public hearing on said dates, the Planning and Zoning Commission <br />considered and voted to approve the requests on April 13, 2010, and recommended that the <br />• requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on May 4, 2010 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "VLDR" <br />Very Low Density Residential to "MU" Mixed Use: <br />Legal description: A .07 acre, more or less, tract of land out of the Thomas J. Chambers <br />Survey Abstract No. 2 as described in exhibit "A ", attached hereto. <br />SECTION 2. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />• City Land Development Code, is amended to rezone the tract of real property described in <br />
