In the event that the Police Chief has reasonable grounds to believe that any permit • <br />holder has been convicted of or spent time in iail or prison for an offense as specified in section <br />18.321(a)(3) of this article within the prior five vears. then the Police Chief may revoke the <br />permit following a notice of the grounds and a hearing as provided in section 18.321(c) of this <br />article. In the event that the hearing officer determines that the permit should be revoked, then he <br />shall issue his final decree to be effective in 30 days following the mailing of notice of the decree <br />to the permit holder in order to allow the permit holder an opportunity before the permit must be <br />surrendered to seek an injunction or iudicial review of the decision. <br />Sec. 18.325 Conduct of emplovees. <br />(a) It shall be unlawful for anv entertainer to touch a customer or the clothing of a customer <br />while engaging in entertainment or while exposing any specified anatomical areas. or <br />engaging in anv specified sexual activities. <br />(b) It shall be unlawful for anv emplovee to engage in entertainment or to expose anv <br />specified anatomical areas or engage in anv specified sexual activities in the presence of <br />a customer in anv separate area within an enterprise to which entry or access is blocked <br />or obscured by anv door, curtain or other barrier separating entry to such area from anv <br />other area of the enterprise. <br />(c) It shall be unlawful for an entertainer to be located less than three (3) feet from a <br />customer while engaging in entertainment or while exposing anv specified anatomical • <br />areas or engaging in anv specified sexual activities. <br />(d) It shall be unlawful for a customer to touch an entertainer or the clothing of an <br />entertainer while the entertainer is engaging in entertainment. or while exposing any <br />specified anatomical areas or engaging in anv specified sexual activities. <br />Secs. 18.326 - 18.339 Reserved <br />DIVISION 4. PENALTIES <br />Sec. 18.340. Penalties. <br />(a) The violation of any provision of this article, including the doing of anvthing which is <br />herein prohibited or declared to be unlawful or the failure to do anvthing or perform anv duty, <br />which is required herein, shall be punishable as provided by Section 243.01 ON of the Local <br />Government Code. Each day that anv violation shall continue shall constitute and be punishable, <br />as provided by Section 243.01 ON of the Local Government Code.
