RESOLUTION 2010 -77R • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A SUBSTANTIAL AMENDMENT TO THE FISCAL YEAR 2009 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM ACTION PLAN FOR THE REALLOCATION OF FUNDS IN THE AMOUNT OF $53,2000.00 FROM THE VICTORY GARDENS PARK PROJECT TO PAY FOR THE INSTALLATION OF A NEW PLAYGROUND STRUCTURE WITH SHADE COVER AT HEB PARK AT 801 PATTON STREET; AUTHORIZING THE CITY MANAGER TO ACT AS THE OFFICIAL REPRESENTATIVE OF THE CITY IN MATTERS RELATED TO THE CDBG PROGRAM AND ACTION PLAN; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. In connection with the proposed HEB Park Project, the City is considering a substantial amendment to its Fiscal Year 2009 Community Development Block Grant ( "CDBG ") Program Action Plan for the reallocation of funding from the Victory Garden Park Project in the amount of $53,200.00 to pay for the installation of a new playground structure with shade cover at HEB Park located at 801 Patton Street. • 2. The City Council conducted a public hearing on the amendment of the 2009 CDBG Action Plan and prior to the public hearing provided a 30 day citizen comment period in order to accept written comments on the proposed amendment. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The Fiscal Year 2009 CDBG Action Plan is amended to reallocate funding from the Victory Garden Park Project in the amount of $53,200.00 for the HEB Park Project to pay for the installation of a new playground structure with shade cover at HEB Park located at 801 Patton Street. PART 2. The City Manager, Rick Menchaca, is authorized to act in all matters related to this Substantial Amendment to the 2009 CDBG Action Plan and all understandings and assurances contained in the Action Plan and to provide additional information as required on behalf of the City. PART 3. This Resolution shall be in full force and effect from and after its passage. •
