<br />223 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, EXPRESSING ITS INTENT TO CALL <br />A SPECIAL RUN-OFF ELECTION, IF NEEDED, FOR SATURDAY, <br />MAY 8, 1976, TO ELECT THE SUCCESSOR TO PLACE SIX <br />OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS. <br /> <br />I <br /> <br />WHEREAS, the Charter of the City of San Marcos, Texas, requires that special <br />run-off elections to elect members for the City Council to be held four (4) <br />weeks following the date of the general election; and, <br /> <br />WHEREAS, four (4) weeks following April 3, 1976, is Saturday, May 1, 1976, <br />the date of state party primaries; and, <br /> <br />WHEREAS, the Law of the State of Texas prohibits local elections from being <br />held in conjunction with state primary elections; and, <br /> <br />WHEREAS, any change in procedure from that already established must be filed <br />with the U.S. Attorney General puruant to the Voting Rights Act; and, <br /> <br />WHEREAS, this Resolution of intent is being made so as to afford ample opportunity <br />to file such change with the U.S. Attorney General's Office and receive his <br />concurrence in a timely fashion; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. That the intent of the City Council of the City of San Marcos be, <br />and is hereby, expressed to be that in the event a run-off election is required <br />to elect the successor to Place Six of the City Council of the City of San Marcos, <br />Texas, said election shall be held five (5) weeks from and after the date of the <br />general election, said run-off election date to be May 8, 1976. <br /> <br />I <br /> <br />PART 2.
