<br />9 <br /> <br />RESOLUTION NO. 1976-23-R <br /> <br />A RESOLUT10N OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, ESTABLISHING PROCEDURE FOR <br />THE SPECIAL RUN-OFF ELECTION TO BE HELD ON THE <br />8TH DAY OF MAY, 1976. <br /> <br />I <br /> <br />1 <br />WHEREAS, the Charter of the City af San Marcos, Texas, requires that a <br />candidate must receive the majority of the votes cast in a regular election <br />to be elected; and <br /> <br />WHEREAS, at the April 3, 1976 Regular City Officers' Election, no candidate <br />far Place 6 received a majority of the votes cast; and <br /> <br />WHEREAS, tliisSCouncil by Resolution dated March 8, 1976, expressed its inter~ <br />to call, a Special Run-Off Election, if needed, for Saturday, May 8,1976,; and <br /> <br />. WHEREAS"the laws of the State of Texas provide that the Election Code of <br />the State of Texas is applicable to said e1ectian, and in order to comply with <br />said Code, an order should be passed establishing the procedure to be fo1101fed <br />in said election, and designating the voting places for said election; now, <br />therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS., TEXAS: <br /> <br />PART 1. That this City, having eleven election precincts, said election <br />shall be held at the following places in said City; <br /> <br />I <br /> <br />In Election Precinct No. 11 at Dunbar Center <br />In Election Precinct No. 12 at Guadalupe Hall <br />In Election Precinct No. 13 at San Marcos'High School Auditorium <br />In Election Precinct No. 20 at Bugg Lane Fire Station <br />In Election Precinct No. 30 at Westover Church <br />In Election Precinct ,No. 33 at Fublic Library <br />In Election Precinct No. 34 at Holland Street Fire Station <br />In Election Precinct No. 36 at American Lutheran Church <br />In Election Precinct No. 44 at Woods Homes Auditorium <br />In Election Precinct Na. 45 at American Legion Building <br />In Election Precinct No. 46 at Travis Elementary Schaal. <br /> <br />PART 2. That the City Secretary is hereby authorized and instructed to <br />provide and furnish all necessary election supplies to conduct said election. <br /> <br />PART 3. That the order in which the names af the candidates are to be printed <br />on the ballot shall be determined by a drawing by the City Secretary as <br />provided by Article 6.05c, Subd. 3. <br /> <br />PART 4. That the Mayor shall give notice of this election in accordance ,"'ith <br />the terms and provisions of Article 4.05 of the Election Code and returns of <br />said notice shall be made as pravided in said Article 4.05, and the Mayor shall <br />issue all necessary orders and writs for said election and returns of saicl <br />election shall be made to the Cauncil immediately after the closing of the polls. <br /> <br />I <br /> <br />PART 5. It is further found and determined that in accordance with the order <br />of this governing body the Secretary posted written notice of the date, place <br />and subject of this meeting an the bulletin board located in the City Hall, a <br />place convenient ta the public, and said notice having been so posted and <br />remaining posted continuously for at least three days preceding the date of this <br />meeting.
