9 RESOLUTION NO. 1976-23-R A RESOLUT10N OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ESTABLISHING PROCEDURE FOR THE SPECIAL RUN-OFF ELECTION TO BE HELD ON THE 8TH DAY OF MAY, 1976. I 1 WHEREAS, the Charter of the City af San Marcos, Texas, requires that a candidate must receive the majority of the votes cast in a regular election to be elected; and WHEREAS, at the April 3, 1976 Regular City Officers' Election, no candidate far Place 6 received a majority of the votes cast; and WHEREAS, tliisSCouncil by Resolution dated March 8, 1976, expressed its inter~ to call, a Special Run-Off Election, if needed, for Saturday, May 8,1976,; and . WHEREAS"the laws of the State of Texas provide that the Election Code of the State of Texas is applicable to said e1ectian, and in order to comply with said Code, an order should be passed establishing the procedure to be fo1101fed in said election, and designating the voting places for said election; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS., TEXAS: PART 1. That this City, having eleven election precincts, said election shall be held at the following places in said City; I In Election Precinct No. 11 at Dunbar Center In Election Precinct No. 12 at Guadalupe Hall In Election Precinct No. 13 at San Marcos'High School Auditorium In Election Precinct No. 20 at Bugg Lane Fire Station In Election Precinct No. 30 at Westover Church In Election Precinct ,No. 33 at Fublic Library In Election Precinct No. 34 at Holland Street Fire Station In Election Precinct No. 36 at American Lutheran Church In Election Precinct No. 44 at Woods Homes Auditorium In Election Precinct Na. 45 at American Legion Building In Election Precinct No. 46 at Travis Elementary Schaal. PART 2. That the City Secretary is hereby authorized and instructed to provide and furnish all necessary election supplies to conduct said election. PART 3. That the order in which the names af the candidates are to be printed on the ballot shall be determined by a drawing by the City Secretary as provided by Article 6.05c, Subd. 3. PART 4. That the Mayor shall give notice of this election in accordance ,"'ith the terms and provisions of Article 4.05 of the Election Code and returns of said notice shall be made as pravided in said Article 4.05, and the Mayor shall issue all necessary orders and writs for said election and returns of saicl election shall be made to the Cauncil immediately after the closing of the polls. I PART 5. It is further found and determined that in accordance with the order of this governing body the Secretary posted written notice of the date, place and subject of this meeting an the bulletin board located in the City Hall, a place convenient ta the public, and said notice having been so posted and remaining posted continuously for at least three days preceding the date of this meeting. A copy of the return of said posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes.
