<br />l~ <br /> <br />STATE OF TEXAS <br /> <br />CONTRACT FOR SERVICES <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, a municipal corporation <br /> <br />I <br /> <br />organized by and under the laws of the State of Texas and Tom <br /> <br />Goynes, doing business as Goynes Canoe Livery of San Marcos, Hays <br /> <br />County, Texas, enter into this agreement for the purpose of pro- <br /> <br />viding recreational opportunities on the San Marcos River and Rio <br /> <br />Vista Park pursuant to the following terms and conditions; to~wit: <br /> <br />I. <br /> <br />The City shall make available to Goynes space at Rio Vista Park <br />for the purposes of providing canoe and innertube rental to visi- <br />tors of Rio Vista Park. The space to be used by Goynes may be <br />designated from day-to-day by the Parks and Recreation Director of <br />the City of San Marcos, Texas, and only that space designated by <br />said Director may be used by Goynes. City agrees to make said <br />space available until April 12, 1977, at which time this agreement <br />shall be terminated. <br /> <br />II. <br /> <br />I <br /> <br />In consideration for being provided space for providing canoe <br />and innertube rentals at said park, Goynes agrees to remit to the <br />City of San Marcos ten percent (10%) of the gross rentals obtained <br />from said rentals. Goynes agrees to remit the ten percent (10%) of <br />the gross receipts to the City of San Marcos at City Hall, San <br />Marcos, Texas, on a monthly basis wifhin ten (10) days following <br />the calendar month for which the remittance is made. <br /> <br />III. <br /> <br />Goynes hereby agrees that all rentals shall be accompanied by <br />providing all safety equipment including Coast Guard approved life <br />jackets, paddles, and other items necessa~y for the safe operation <br />of all rented items. Furthermore, Goynes agrees to maintain and to <br />provide evidence of liability insurance in minimum liability Ij~its <br />of $100,000.00 for personal injury and $5,000.00 property damage. <br />Said insurance coverage shall be maintained by Goynes at Goynes <br />expense for the life of this agreement. Goynes also agrees to main- <br />tain all equipment in good repair and the City of San Marcos is hereby <br />authorized to inspect said equipment at reasonable times for the <br />purpose of inspecting quality of the items rented and provided pur- <br />suant to the rental agreement with individual users. <br /> <br />IV. <br /> <br />I <br /> <br />It is understood by and between the City of San Marcos and Goynes, <br />that this agreement authorizes only a single trailer loaded with <br />canoes, innertubes, and safety equipment, and said equipment is to <br />be removed from said park at the end of each business day. Under no <br />circumstances shall this agreement be construed to convey to Goynes <br />the right to place or construct any permanent booths or signs in <br />said park. <br />
