<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, APPROVING THE PRICE AND CONDITIONS OF
<br />THE SALE BY THE URBAN RENEWAL AGENCY OF THE CITY OF
<br />SAN MARCOS, TEXAS, OF PARCEL NO. l5D-12 (SEE LEGAL
<br />READING), LOCATED WITHIN THE JUAN VERAMENDI, PROJECT
<br />N.D.P., TEX. A-6, TO GERONIMO RODRIGUEZ AND ROMANA
<br />RODRIGUEZ, AND DECLARING AN EMERGENCY.

<br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Texas, advertised for
<br />bids for the sale of certain property available for disposition within its Juan
<br />Veramendi Urban Renewal Project N.D.P., Tex. A-6, in the San Marcos Record, a local
<br />newspaper with a general circulation within the City of San Marcos, Hays County, Texas"
<br />and
<br />
<br />WHEREAS, pursuant to said advertisement there was a bid submitted by Geronimo Rodriguezl
<br />and Romana Rodriguez for all of Parcel No. l5D-12 within said project; and
<br />
<br />WHEREAS, the said bid met the minimum'disposition price set upon said property by
<br />the Agency; and
<br />
<br />WHEREAS, said bid was accepted by the Board of Conunissioners of the Urban Renewal
<br />Agency of the City of San Marcos, Texas, after the bid opening of April 6, 1976,
<br />and by a Resolution duly passed on April 6, 1976, and whereas said Resolution author-
<br />izes sale to Geronimo Rodriguez and Romana Rodriguez, and recommended the aceeptance
<br />and approval of the terms and conditions of the sale to the City Council; and
<br />
<br />WHEREAS, the aforementioned bid 'and proposed use set forth in said bid and its terms
<br />and conditions conform to the Redevelopment Plan for the Juan,Veramendi Project,
<br />N.D.P., Tex. A-6, and conform to the plan for the development, of the City as a whole;
<br />now, therefore,

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:

<br />That the price and conditions of the sale by the Urban Renewal Agency of
<br />of San Marcos, Texas, of all of Parcel No. l5D-12 within the Juan V,eramendi
<br />N.D.P., 'Tex. A-6, to Geronimo Rodriguez and Romana Rodriguez, are hereby
<br />in accordance with Section '11 of Article l269L-3, Vernon's Annotated Civil
<br />of Texas.

<br />PART 2. That the property to be sold as authorized in paragraph 1 above is :more
<br />particularly described by field notes attached hereto and marked as Exhibit "A" of
<br />this Ordinance.
<br />
<br />PART 3. That the consideration for said sale being $1,875.00 for 6,391 square feet
<br />is also hereby approved.
<br />
<br />PART 4. That the sale by the Urban Renewal Agency is made subject to the restriction
<br />of the Redevelopment Plan for the Juan Veramendi Project N.D.P., Tex. A-6, as approved'
<br />and amended an on file in the office of the Director of Community Development.

<br />PART 5. That the purchaser is hereby placed on notice that the subject property is
<br />subject to assessment under the provisions of Article 1105b of the Revised Civil
<br />Statutes of Texas, now and as hereafter amended.
<br />
<br />PART 6. That the conditions of the disposition documents, including the Deed and
<br />Contract for Sale of Land for Private Redevelopment, a copy of which is on file in thE
<br />office of the Director of Community Development.

<br />PART 7. That the importance of this Ordinance creates an emergency and an imperative
<br />purpose necessary that the provisions of the Charter requiring that all Ord:lnances be
<br />read at three separate meetings and that no Ordinance shall become effectiv,~ until th
<br />expiration of 10 days following the date of its final passage be suspended, and this
<br />provision is hereby suspended, and this Ordinance shall take effect and be :in force
<br />from and after its adoption, and publication in a newspaper of general circ111ation in
<br />the City.
