<br />I <br /> <br />22 <br /> <br />RESOLUTION NO. 1976-27-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING AN AGREEMENT BETWEEN <br />H. GARLAND STOKES, MILDRED O. STOKES, AND HERBERT <br />YARBROUGH, JR., AND THE CITY OF SAN MARCOS FOR <br />THE EXCHANGE OF RIGHT-OF-WAY LOCATED AT THE <br />PROPERTY COMMONLY KNOWN AS "THE OLD MILL PROPERTY" <br />AND AUTHORIZING THE MAYOR'TO_EXECUTE SAID AGREEMENT <br />IN AND ON BEHALF OF THE CITY OF SAN MARCOS, TEXAS. <br /> <br />WHEREAS, the portions of that certain property commonly <br />known as "the old mill property" lias cpljImonly been used for <br />right-of-way purposes by the public to traverse said property; <br />and, <br /> <br />WHEREAS, the City of San Marcos, Texas, in behalf of <br />the public, may have acquired some interest in said right-of- <br />way travers ing said" property; and, <br /> <br />WHEREAS, H. Garland Stokes, Mildred O. Stokes, and <br />Herbert Yarbrough, Jr., desire to dedicate property for the use <br />of public street across said property in exchange for the City of <br />San Marcos relinquishing any claim to that right-of-way previously <br />used; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />PART I: That the agreement between H. Garland Stokes, <br />Mildred O. Stokes, and Herbert Yarbrough, Jr., and the City of <br />San Marcos, which is attached hereto and incorporated herein, <br />be, and is hereby, in all things approved. <br /> <br />PART 2: That the Mayor of the City of San Marcos, <br />Texas, Dr. Emmie Craddock, or her successor, be., and is hereby, <br />authorized to execute said agreement in and on behalf of the <br />City of San Marcos, Texas. <br /> <br />PART 3: That this Resolution shall become effective <br />immediately from and after its passage. <br /> <br />ADOPTED this 26th <br /> <br />day ;APr~~6 <br /> <br /> <br />~ Craddock <br />Mayor <br /> <br />~ <br /> <br /> <br />ApPROVED: <br /> <br />I <br /> <br />C c)' A i Qjney-. <br />
