<br />24-e <br /> <br />the efforts of the Commission to secure voluntary compliance have been unsuc- <br />cessful, the Commission shall cause the Fair Housing Officer to certify in <br />writing to the City Attorney that such discriminatory housing practice has <br />occurred in the determination of the Fair Housing Commission and request the <br />Cit:r Attorney to forthwith prosecute such violation in the Municipal Court of <br />the City of San Marcos, Texas. <br /> <br />SECTION 32-14. Legal Proceedings. <br /> <br />(A) Upon certification to the City Attorney pursuant to the direction of <br />the Commission, the City Attorney shall institute a charge in Municipal Court I <br />and prosecute the same to final conclusion. <br /> <br />(B) The actions taken by the City Attorney shall be cumulative of all <br />other remedies and procedures for the effectuation and enforcement of this <br />Ordinance and the prosecution of alleged violators of this Ordinance. <br /> <br />SEC~'ION 32-15. Cooperation with Secretary of Housing and Urban Development. <br /> <br />The Commission and the Fair Housing Officer are authorized to cooperate <br />with the Secretary of Housing and Urban Development pursuant to the provisions <br />of Title VII - Fair Housing Act of 1968, Public Law 90-284, and may render such <br />service to the Secretary as shall be deemed appropriate to further the policies <br />of this Ordinance. <br /> <br />ARTICLE IV: FAIR HOUSING COMMISSION <br /> <br />SECTION 32-16. Appointment; Terms. <br /> <br />There is hereby created a Fair Housing Commission to be known as the San <br />Marcos Fair Housing Commission. The Commission shall consist of five (5) <br />members, all of whom shall be residents of the City of San Marcos. Membership <br />to the Commission shall be established by appointment by the City Council and <br />appointments shall be made at the first regular meeting in January. Appointees <br />shall serve for a period of two (2) years. Vacancies shall be filled by appoint- I <br />memt by the City Council for the unexpired portion of the term to be filled. In <br />creating the first Commission, three (3) members shall be appointed to serve <br />until January 1, 1978, and two (2) members shall be appointed to serve until <br />Janua.ry 1, 1977. <br /> <br />SECTION 32-17. Powers and Duties. <br /> <br />The Fair Housing Commission shall sit to hear complaints of alleged dis- <br />criminatory housing practices ,fithin the City of San Marcos. The Commission shall <br />sit in an effort to assist the City and the parties to the complaint in the <br />settling of disputes and controversies arising under the terms of this Ordinance. <br />The Commission shall have the power to hear the production of evidence from the <br />parties involved and to solicit evidence from the City staff or any other source. <br />The Commission shall be required to file its findings and determinations in <br />writing as well as any recommendations for final resolution of the matter. This <br />Commission shall sit only as and in the capacity of an intermediary for the purpose <br />of providing an opportunity for the parties to resolve all disputes and contro- <br />versies. Participation before the Commission shall be solely on a voluntary basis. <br /> <br />ARTICLE V: LEGAL PROVISIONS <br /> <br />SECTION 32-18 . Penalty. <br /> <br />Any person violating any provision of this Ordinance within the corporate <br />limits of the City of San Marcos shall be guilty of a Class C misdemeanor, and I. <br />upon conviction shall be fined an amount not exceeding Two Hundred Dollars ($200.00 <br />Each day that such violation continues shall be a separate offense. Prosecution <br />or conviction under this provision shall never be a bar to any other remedy or <br />relief for violations of this Ordinance. <br />
