The City Council of the City of San Marcos, Texas, provided an opportunity gofall~ interested persons to be heard at two public hearings, held on March 12.. 2004 en and on March 19, 2004 , to consider the proposed annexation by the City of 79.268 acres, more or less, located off of the 5600 block~ of IH-35 SOllth, in Hays County, Texas (the "Almexatio11 Area"), consisting oftl1e 81.553 acre, 1110re or less, tract of land described by n1etes and bounds in t11e attac11ed Exhibit A (H&H Industrial Parl( Tract), save a11d except t11e 2.285 acre, more or less, portion of that tract already located in tl1e city limits, as depicted on tl1e lnap attached as Exhibit B. RECITALS: 2. The City has received a petition for alll1exation from the owner(s) of the property included in the Annexation Area, a copy of which is attached as Exhibit C. The City Council considered the request and on May 12, 2003, adopted a resolution approving tl1e extension of City utilities to serve tIle Annexation Area in accordance with the petition. 3. All Ol1-site Pllblic hearing has not been requested in writing by more than 10% of the adults who are permanent residents of the Annexation Area. 4. A notice of each of the public hearings was published ill the San Marcos Daily Record, a newspaper having general circulatioll in the City and in the Annexation Area, on March 5, 2004 and March 12" 2004 , these dates being on or after the 20th day and before tIle 10tIl day before the date of the respective hearings. A notice of 'each of tIle public hearings was also posted on the City's Internet website 011 or after the 20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on the web site until the dates of the respective hearings. 5. Prior to tIle Pllblication of t11e notices of the public 11eari11gs, tIle City COllncil directed preparation of a service plan tl1at provided for tl1e extension of lTIllnicipal services to t11e Annexation Area. 6.
