<br />37 <br /> <br />ORDINANCE NO. 1976 - l7 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE PRICE AND CONDITIONS OF THE SALE BY THE URBAN RENEWAL <br />AGENCY OF THE CITY OF SAN MARCOS, TEXAS, OF PARCEL NO. 16D-3 (SEE <br />. LEGAL READING), LOCATED WITHIN THE JUAN VERAMENDI PROJECT, N. D. P. <br />TEX. A-6, TO IRENE NOAH; AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Texas, advertisE,d for <br />bids for the sale of certain property available for disposition within its J1;,an <br />Veramendi Urban Renewal Project, N.D.P.Tex. A-6, in the San Marcos Record, a local <br />newspaper with a general circulation within the City of San Marcos, Hays County, <br />Texas; and <br /> <br />I <br /> <br />WHEREAS, pursuant to said advertisement there was a bid submitted by Irene Noah <br />for all of Parcel No. 16D-3 within said project; and <br /> <br />WHEREAS, the said bid met the minimum disposition price set upon said property by <br />the Agency; and <br /> <br />WHEREAS, said bid was accepted by the Board of Commissioners of the Urban Renewal <br />Agency of the City of San Marcos, Texas, after the bid opening of May 4, 1976, and <br />by a Resolution duly passed on May 4, 1976, and whereas said Resolution authorizes <br />sale of Irene Noah, and recommended the acceptance and approval of the terms and <br />conditions of the sale to the City Council; and <br /> <br />WHEREAS, the aforementioned bid and propsoed use set forth in said bid and its terms <br />and conditions conform to the Redevelopment Plan for the Juan Veramendi Project, <br />N.D.P., Tex. A-6, and conform to the plan for the development of the City as a <br />whole; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. That the price and conditions of the sale by the Urban Renewal Agency of <br />the City of San Marcos, Texas, of all of Parcel No. 16D-3 within the Juan Veramendi <br />Project, N.D.P., Tex. A-6, to Irene Noah, are hereby approved in accordance with <br />Section 11 of Article 1269L-3, Vernon's Annotated Civil Statutes of Texas. <br /> <br />I <br /> <br />PART 2. That the property to be sold as authorized in paragraph 1 above is more <br />particularly described by a legal. description attached_I and marked as Exhibit "A" <br />of this Ordinance. <br /> <br />PART 3. That the consideration for said sale being $1,825.00 for 6,009 square feet <br />is also hereby approved. <br /> <br />PART 4. That the sale by the Urban Renewal Agency is made subject to the restrictior <br />of the Redevelopment Plan for the Juan Veramendi Project, N.D.P., Tex. A-6,. as appro" <br />and amended and on file in the Office of the Director of Community Development. <br /> <br />PART 5. That the purchaser is hereby placed on notice that the subject property is <br />subject to assessment under the provisions of Article 1105b of the Revised Civil <br />Statutes of Texas, now and as hereafter amended. <br /> <br />PART 6. That the conditions of the disposition documents, including the deed and <br />contract for sale of land for private redevelopment, a copy of which is on file in <br />the Office of the Director of Community Development. <br /> <br />PART 7.
