I I I 72 RESOLUTION NO. 1976-43-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AND ACCEPTING THE COMPLETION OF CONSTRUCTION ON THE BROADWAY STREET AREA IMPROVEMENT PROJECTS, AND AUTHORI- ZING THE FINAL PAYMENT FOR THESE IMPROVEMENTS. WHEREAS, the City Council of the City of San Marcos, Texas, has contracted with Leo P. Cloud, Jr. and Son for improvements in the Broadway Street area, including the paving of and installation of drainage along Broadway Street and the construction of sidewalks along State Highway 123; and, WHEREAS, these improvements have been inspected and approved by representatives of the City of San Marcos, URS! Forrest and Cotton, and James E. Byrn as being in compliance with the terms and conditions for such improvements; and, WHEREAS, Leo P. Cloud, Jr. and Son requests final payment for the satisfactory completion of these improvements; now" therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the work performed by Leo P. Cloud, ,Jr. and Son on the Broadway Street area improvements, i.e, the Broadway Street Improvement Project and the construction of sidewalks along State Highway 123, be, and is hereby, approved and accepted as being complete pursuant to the terms of the contracts for such improvements. SECTION 2. That the City of San Marcos is authorized to make the final payment to Leo P. Cloud, Jr. and Son for these improvements. SECTION 3.
