I I I 74 ORDINANCE NO. 1976 - 27 AN ORDINANCE DETERMINING AND FIXING THE MAXIMUM SCHEDULES OF RATES TO BE CHARGEDBBY ENTEX, INC., IN THE CITY OF SAN MARCOS, TEXAS, FOR NATURAL GAS AND NATURAL GAS SERVICE FURNISHED BY IT TO RESIDEN- TIAL AND COMMERCIAL CONSUMERS, CONTAINING DEFINI- TIONS, FIXING THE EFFECTIVE DATES FOR GAS RATES PRESCRIBED IN THIS ORDINANCE, MAKING MISCELLANEOUS PROVISIONS AND REPEALING ALL ORDINANCES IN CONFLICT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, I TEXAS: SECTION 1. That Entex, Inc., is hereby authorized to place in effect the following schedules of rates within the cor- porate limits of the City of San Marcos, Texas, (hereinafter called "City") for the supply of natural gas and natural gas service. RESIDENTIAL RATES Rate Scheduel R-189-1-A, a copy of which is attached, marked Exhibit "A", and made a part hereof. COMMERCIAL RATES RatesSchedule SC-189-1-A, a copy of which is attached, marked Exhibit "B", and made a part hereof. The above-described schedule of residential rates and of commer- cial rates are the highest rates that may be charged by Entex, Inc., for residential consumers and commercial consumers within the City.. Other lower residential rates and commercial rates may be fixed and determined from time to time by Entex, Inc., for gas and gas service furnished to residential consumers and com- mercial consumers within the City. SECTION 2. That the terms "residential consumer" and "com- mercial consumer" as used herein shall be defined as set out in said Exhibits "A" and "B", respectively. SECTION 3. That natural gas supplied by Entex, Inc." is for the individual use of the consumer at one point of delivery and shall not be resold or shared with others. SECTION 4. That the maximum rates and charges prescribed in this ordinance for residential consumers and commercial con- sumers shall apply as maximum rates and charges on all bills rendered for gas and for gas service after the effective date of this ordinance, viz, the date of passage hereof. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of the conflict only, SECTION 6. That nothing contained in this ordinance shall be construed as in any manner, now or hereafter, limiting or modi- fying the righfu 'anddpower of the City, under the law, to regulate the rates charged by Entex, Inc., within the City.
