<br />i <br /> <br />BOa <br /> <br />STATE OF TEXAS <br /> <br />CONTRACT FOR SERVICES <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />I <br /> <br />That the City of San Marcos, Texas, a Municipal Corporation, <br />by and under the Laws of the State of Texas, acting by and through <br />its Mayor, Dr; Emmie Craddock, and the San Marcos Chamber of Com-- <br />merce enter into this agreement pursuant to the terms and provi- <br />sions of Chapter 26, Article II of the Code of Ordinances for the <br />City of San Marcos, Texas, <br /> <br />WITNESSTH: <br /> <br />I. <br /> <br />The City of San Marcos has enacted by ordinance a Hotel Rooln <br />Occupancy Tax to be levied upon the occupancy of any room furnished <br />by any hotel within such City. Pursuant to Section 26-21, "Use of <br />Proceeds," the City does hereby agree to allocate funds from the <br />revenue of said tax to the San Marcos Chamber of Commerce. The' <br />allocation of funds to said Chamber is hereby agreed to be ninety <br />percent (90%) of the gross of all funds collected from the Hotel <br />Room Occupancy Tax. Furthermore, it is expressly agreed that the <br />Chamber shall be entitled to operating and administrative expres- <br />ses not exceeding fifteen percent (15%) of the total allocation <br />of funds received by said Chamber. <br /> <br />II. <br /> <br />I <br /> <br />The San Marcos Chamber of Commerce does hereby agree to expend <br />said funds for advertising for general promotional and tourist <br />advertising of the City and its vicinity, and conducting a soli-- <br />citation and operating program to attract conventions and visitors <br />to the City. The Chamber of Commerce further agrees to submit a <br />semi-annual budget to said City requesting funds available from <br />the revenue of said tax. Such budget presentations shall include <br />a report of activities and expenditures from previously allocated <br />funds. <br /> <br />III. <br /> <br />It is hereby agreed that a tourist development committee <br />shall be formed to serve as an advisory committee to said Chamber <br />and no funds allocated from said tax shall be expended without the <br />advice and consent of said committee. The membership of the COJrumit- <br />tee is agreed to be five (5) persons who shall serve for the dura- <br />tion of this agreement. It is specifically agreed between the <br />parties hereto that two (2) members shall be appointed by the City <br />Council of said City and two (2) members shall be appointed by the <br />Board of Directors of said Chamber. The fifth member shall be <br />selected by the four (4) appointees. The City Manager of said City <br />and the Manager of said Chamber shall be ex-officio members of the <br />committee. <br /> <br />I <br /> <br />IV. <br /> <br />The term of this contract shall be one (1) year from the date <br />of execution by both parties.
