i BOa STATE OF TEXAS CONTRACT FOR SERVICES COUNTY OF HAYS KNOW ALL MEN BY THESE PRESENTS: I That the City of San Marcos, Texas, a Municipal Corporation, by and under the Laws of the State of Texas, acting by and through its Mayor, Dr; Emmie Craddock, and the San Marcos Chamber of Com-- merce enter into this agreement pursuant to the terms and provi- sions of Chapter 26, Article II of the Code of Ordinances for the City of San Marcos, Texas, WITNESSTH: I. The City of San Marcos has enacted by ordinance a Hotel Rooln Occupancy Tax to be levied upon the occupancy of any room furnished by any hotel within such City. Pursuant to Section 26-21, "Use of Proceeds," the City does hereby agree to allocate funds from the revenue of said tax to the San Marcos Chamber of Commerce. The' allocation of funds to said Chamber is hereby agreed to be ninety percent (90%) of the gross of all funds collected from the Hotel Room Occupancy Tax. Furthermore, it is expressly agreed that the Chamber shall be entitled to operating and administrative expres- ses not exceeding fifteen percent (15%) of the total allocation of funds received by said Chamber. II. I The San Marcos Chamber of Commerce does hereby agree to expend said funds for advertising for general promotional and tourist advertising of the City and its vicinity, and conducting a soli-- citation and operating program to attract conventions and visitors to the City. The Chamber of Commerce further agrees to submit a semi-annual budget to said City requesting funds available from the revenue of said tax. Such budget presentations shall include a report of activities and expenditures from previously allocated funds. III. It is hereby agreed that a tourist development committee shall be formed to serve as an advisory committee to said Chamber and no funds allocated from said tax shall be expended without the advice and consent of said committee. The membership of the COJrumit- tee is agreed to be five (5) persons who shall serve for the dura- tion of this agreement. It is specifically agreed between the parties hereto that two (2) members shall be appointed by the City Council of said City and two (2) members shall be appointed by the Board of Directors of said Chamber. The fifth member shall be selected by the four (4) appointees. The City Manager of said City and the Manager of said Chamber shall be ex-officio members of the committee. I IV. The term of this contract shall be one (1) year from the date of execution by both parties. It is expressly agreed that either
