<br />no <br /> <br />RESOLUTION NO. 1976-51-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, SETTING FORTH CITY POLICY PERTAINING TO CONDITIONS, <br />RESTRICTIONS OR COVENANTS REQUIRED ON SALES OF LANDS ACQUIRED <br />THROUGH THE COMMUNITY DEVELOPMENT PROGRAM AND REQUIRING <br />PROSPECTIVE BIDDERS ON SUCH LANDS TO MEET FEDERAL REQUIREMENTS <br />IN ADDITION TO POSTING A 5% BID DEPOSIT AND INCLUDING A STATE- <br />MENT OF PROPOSED USE AND DEVELOPMENT FOR SAID PROPERTY. <br /> <br />I <br /> <br />WHEREAS, the City has purchased all of the land inventory previously held by the <br />Urban Renewal Agency; and <br /> <br />WHEREAS, the Federal Government had placed certain conditions, restrictions or <br />corenants on such land while title resided with the Federal Government; and <br /> <br />WHEREAS, only four such conditions, restrictions or covenants are now required by <br />the Federal Government on that land purchased by the City; and <br /> <br />WHEREAS, prospective bidders on this property need to be informed of mandatory <br />Federal and City conditions, restrictions or covenants placed on the property; <br />now) therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Part 1. That the City Council of the City of San Marcos hereby establishes a <br />policy regarding conditions, restrictions or covenants attached to lands previously <br />held by the Urban Renewal Agency and now held by the City. <br /> <br />Part 2. That said policy shall include the following conditions, restrictioml or <br />covenants to be required in future sales of said lands by the City: <br /> <br />I <br /> <br />1. The successful bidder and any successor shall devote the property <br />to uses in accordance with the Urban Renewal Plan for Project N9. <br />Tex. A-6. <br /> <br />2. Any improvements on such property required by the Urban Renewal Plan <br />shall be begun within a reasonable time after the property is acquired <br />: for purposes of redevelopment. <br /> <br />3. Any proposed recorivenances 'of such property for purposes of redevelopment <br />shall be' subject to the public disclosure requirements otherwise applic~ <br />able to local public agencies in the disposition of project land to <br />redevelopers under Section 105(e) of Title I of the Housing Act of 1949, <br />as amended. <br /> <br />4. The successful bidder agrees for itself and any successor in interest not <br />to discriminate upon the basis of race, color, religion, sex, or national <br />origin in the sale, lease, or rental or in any use or occupancy of such <br />land or any improvements erected or to be erected thereon or any part <br />thereof. <br /> <br />5. A bid deposit in the amount of 5% of bid shall be required of all bidders. <br /> <br />6.
