<br />116 <br /> <br />ORDINANCE NO. 1976 - 33 <br /> <br />-;} <br /> <br />AN ORDINANCE APPROVING AND ADOPTING AMENDMENT <br />No.4 TO THE URBAN RENEWAL PLAN FOR N.D.P. <br />PROJECT TEX. A-6, FINAL ACTION YEAR, AND <br />DIRECTING THAT SAID CHANGE BE FILED AS PART <br />OF THE URBAN RENEWAL PLAN FOR SAID PROJECT. <br /> <br />I <br /> <br />WHEREAS, the City has adopted a Redevelopment Plan known as the Urban Renewa.l <br />Plan for N.D.P. Project Tex. A-6, Final Action Year; and <br /> <br />WHEREAS, the Urban Renewal Agency has now proposed Amendment No.4 to said Plan <br />for the purpose of effectuating a change in land use concerning two irregular <br />shaped tracts of land located in the project boundaries with said field note <br />descriptions attached and made a part hereof; and <br /> <br />WHEREAS, said Amendment No. 4 has been submitted to and approved by the Bow~d <br />of Commissioners of the Urban Renewal Agency of the City of San Marcos, Texas, <br />by Resolution dated August 10, 1976; and <br /> <br />WHEREAS, in addition said Amendment No. 4 has been submitted to the Planning and <br />Zoning Commission of the City of San Marcos and received its favorable recommenda- <br />tion and said recommendation has been forwarded to this body; and <br /> <br />WHEREAS, said Plan, as amended, will conform to the general plan for recevelopment <br />of the City as a whole; and <br /> <br />WHEREAS, the provisions of the Texas Urban Renewal Law, Article 1269L-3, <br />Section 7e of the Vernon' s Annotated Civil Statutes of Texas regarding modifi- <br />cations in Urban Renewal plans have been complied with; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />SECTION 1. That Amendment No.4 consisting of one (1) page of textual material <br />and an amended exhibit Land Use Map 3AA and accompanying survey changing the land <br />use as depicted therein of two irregular shaped tracts of land from Multi-Family <br />Use to Park Use, all a part of the Urban Renewal Plan for N.D.P. Project Tex. A-6, <br />is hereby ratified, adopted and approved. <br /> <br />SECTION 2. That Amendment No. 4 is attached hereto and made a part hereof. <br /> <br />SECTION 3. That the City Secretary is hereby directed to maintain a copy of <br />said Amendment No. 4 on file in her records as public notice of the change in <br />the Redevelopment Plan for N.D.P. Project Tex. A-6, Final Action Year, and said <br />Amendment shall be binding on all redevelopers within the said project area. <br /> <br />SECTION 4.
