<br />124 <br /> <br />RESOLUTION NO. 1976-54-R <br /> <br />I <br /> <br />A RESOLUTION.OF' THE.CITY COUNCIL.OF THE CITY <br />OF SAN MARCOS~ TEXAS, SETTING FORTH CITY <br />POLICY REGARDING THE ESTABLISHMENT OF A <br />CLEARLY DEFINED PUBLIC RIGHT-OF-WAY ON <br />FREDERICKSBURG STREET FROM SAN ANTONIO STREET <br />TO COMAL STREET, AND THE FUTURE PAVING OF <br />SAID STREET. <br /> <br />WHEREAS, there are no ~learly defined public right~of~way <br />lines extending along Fredericksburg Street from San Antonio Street <br />and Comal Street, between Block 12 and Block 16 of the original <br />town of San Marcos plat as recorded in ,Volume 46, Page 448 of <br />the Hays County Deed Recorfts; and <br /> <br />WHEREAS, individual property records vary from property <br />description to property description as pertain to said public <br />right-of-way; and <br /> <br />WHEREAS, present construction on and-future paving plans for <br />said street make it advisable to clarify existing public right-of- <br />way and boundary questions; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Part 1. That the City Council of the City of San Marcos hereby <br />establishes a policy regarding the establishment of a clearly <br />defined public right-of-way on 'Frederic'ksburg Street and regardlng <br />the paving of said street. <br /> <br />I <br /> <br />Part 2. That said policy shall include the following provisions: <br /> <br />(1) The establishment of a public right-of-way on <br />Fredericksburg Street extending from San Antonio <br />Street to Comal Street and being 25 feet in width. <br /> <br />(2) The permanent marking of the lines of said right~ <br />of-way by concrete markers to be located at the <br />intersections of Fredericksburg Street with <br />San Antonio Street and Coma1 Street. <br /> <br />(3) The paving and construction of curbin'g within <br />said right-of-way to include a total width of <br />23 feet from back-of-curb to back-of-curb. <br /> <br />~art 3.
