<br />ORDINANCE NO. 1976 - 35 <br /> <br />139 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />APPROVING THE PRICE AND TERMS OF THE SALE BY THE CITY OF SAN MARCOS, <br />TEXAS OF PARCEL NO. 15D-3 AND PARCEL NO. 15D-4, DESCRIBED FURTHER ON <br />EXHIBIT "A" ATTACHED HERETO, LOCATED WITHIN THE TEX. A-6, NEIGHBORHOOD <br />DEVELOPMENT PROGRAM AREA, TO JEFFREY H. KESTER, AUTHORIZING THE MAYOR <br />TO EXECUTE A WARRANTY DEED TO JEFFREY H. KESTER, AND DECLARING AN <br />EMERGENCY. <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos, Texas advterised for bids for the sale of that <br />certain real property known as Parcel No. 15D-3 and Parcel No. .l5D-4, and described <br />more fully on Exhibit "A" attached hereto, located within the Tex. A-6, Neighborhood <br />Development Program area, in the San Marcos Record, a local ne~spaper with a <br />general circulation within the County of Hays, State of Texas; and <br /> <br />WHEREAS, pursuant to said advertisement, a bid was submitted by Jeffrey H. Kester <br />for said Parcel No. 15D-3 and Parcel No. 15D-4; and <br /> <br />WHEREAS, the said bid met the minimum disposition price set upon said propertJ' by <br />the Board of Commissioners of the Urban Renewal Agency of the City of San Marcos, <br />Texas; and <br /> <br />WHEREAS, the said Board accepted the bid as the highest and best responsible bid <br />for said property by a Resolution duly passed on November 9, 1976, after the bid <br />opening of November 9, 1976; and <br /> <br />WHEREAS, said Resolution also approved the terms and conditions for the sale of <br />the said property and recommended the approval of said purchase price and the approval <br />of the terms and conditions for the sale, as contained in the bid documents, 'by <br />the City Council of the City of San Marcos, Texas; and <br /> <br />I <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and the sales <br />terms and conditions pertinent thereto conform to the Redevelopment Plan for the <br />Tex. A-6, Neighborhood Development Program, and conform to the plan for the develop- <br />ment of the City as a whole; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That the terms<,and conditions of the sale by the City of San Marcos, <br />Texas of parcel No. 15D-3 and Parcel No. 15D-4 within the Tex. A-6, Neighborhood <br />Development Program area, and more fully described on Exhibit "A" attached hereto, <br />to Jeffrey H. Kester are hereby approved. <br /> <br />Section 2. That the consideration for the sale for said property being $3,100.00 <br />for 10,652 square feet is hereby approved. <br /> <br />Section 3. That the sale by the City of San Marcos is made subject to restrictions <br />of the Redevelopment Plan for the Tex. A-6, Neighborhood Development Program" as <br />approved and amended; said plan is on file and is available for inspection in the <br />Office of the Director of Community Development of the City of San Mancos. <br /> <br />Section 4. That the conditions of the disposition documents, including the Deed <br />and Contract of Sale for Private Redevelopment, are on file and are available for <br />inspection in the Office of the Director of Community Development of the CitJ' of <br />San Marcos. <br /> <br />I <br /> <br />Section 5. The purchaseriishher!'lpyppllaced on notice that the subject property is <br />subject to assessment under the provisions of Article 1105b of the Revised Civil <br />Statutes of the State of Texas. <br /> <br />Section 6. That the Mayor of the City of San Marcos is hereby authorized to execute <br />a warranty deed to Jeffrey H. Kester, from the City of San Marcos, for all that real <br />property known as Parcel No. 15D-3 and Parcel No. 15D44, located within the 'rex. A-6, <br />Neighborhood Development Program, and described more fully on Exhibit "A" attached <br />hereto. <br />
