<br />146a <br /> <br />EXHIBIT A <br /> <br />STATE: OF TEXAS <br />COUNTY OF HAYS <br /> <br />CONTRACT FOR SERVICES <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, a Municipal Corporation, by and under <br />the laws of the State of Texas, acting by and through its Mayor, Dr. Emmie Craddock, <br />and the San Marcos Chil.mber of Commerce enter into this agreement pursuant to the <br />terms and provisions of Chapter 26, Article II of the Code of Ordinances for the <br />City of San Marcos, Texas. <br /> <br />WITNESSETH <br /> <br />I <br /> <br />1. <br /> <br />~'he City of San Marcos has enacted by ordinance a Hotel Room Occupancy Tax to <br />be levied upon the occupancy of any room furnished by any hotel within such City. <br />Pursuant to Section 26-21, "Use of Proceeds," the City does hereby agree to allocate <br />funds from the revenue of said tax to the San Marcos Chamber of Commerce. The alloca- <br />tion of funds to said Chamber is hereby agreed to be ninety percent (90%) of the gross <br />of all funds collected from the Hotel Room Occupancy Tax. FurtherDIDre, it is expressly <br />agreed that the Chamber shall be entitled to operating and administrative expenses not <br />exceeding fifteen percent (15%) of the total allocation of such funds collected from <br />the Hotel Room Occupancy Tax to be received by said Chamber. <br /> <br />II. <br /> <br />The San Marcos Chamber of Commerce does hereby agree to expend said funds for <br />advertising for general promotional and tourist advertising of the City and its vicin- <br />ity, and conducting a solicitation and operating program to attract conventions and <br />visitors to the City. The Chamber of Commerce further agrees to submit a semi-annual <br />budget to said City re~uesting funds available from the revenue of said tax. Such <br />budget presentations shall include a report of activities and expenditures from <br />previously aL~ocated funds. <br /> <br />III. <br /> <br />I <br /> <br />It is hereby agreed that a tourist development committee shall be formed to <br />serve a:3 an advisory committee to said Chamber and no funds allocated from said tax <br />shall be expended without the advice and consent of said committee. The membership <br />of the eommittee is agreed to be five (5) persons who shall serve for the duration of <br />this agreement. It is specifically agreed between the parties hereto that two (2) <br />members shall be appointed by the City Council of said City, and two (2) members shall <br />be appointed by the Board of Directors of said Chamber. The fifth member shall be <br />selected, by the four (4) appointees. The City Manager of said City and the Manager of <br />said Chamber shall be ex-officio members of the Committee. <br /> <br />IV. <br /> <br />The term of this contract shall be one' '(1) year from the date of execution by . <br />both parties. It is expressly agreed that either party may cancel this agreement by <br />tendering written notice to the other. Upon the expiration of thirty (30) days from <br />the date of said notice, this agreement shall become null and void.
