146a EXHIBIT A STATE: OF TEXAS COUNTY OF HAYS CONTRACT FOR SERVICES KNOW ALL MEN BY THESE PRESENTS: That the City of San Marcos, Texas, a Municipal Corporation, by and under the laws of the State of Texas, acting by and through its Mayor, Dr. Emmie Craddock, and the San Marcos Chil.mber of Commerce enter into this agreement pursuant to the terms and provisions of Chapter 26, Article II of the Code of Ordinances for the City of San Marcos, Texas. WITNESSETH I 1. ~'he City of San Marcos has enacted by ordinance a Hotel Room Occupancy Tax to be levied upon the occupancy of any room furnished by any hotel within such City. Pursuant to Section 26-21, "Use of Proceeds," the City does hereby agree to allocate funds from the revenue of said tax to the San Marcos Chamber of Commerce. The alloca- tion of funds to said Chamber is hereby agreed to be ninety percent (90%) of the gross of all funds collected from the Hotel Room Occupancy Tax. FurtherDIDre, it is expressly agreed that the Chamber shall be entitled to operating and administrative expenses not exceeding fifteen percent (15%) of the total allocation of such funds collected from the Hotel Room Occupancy Tax to be received by said Chamber. II. The San Marcos Chamber of Commerce does hereby agree to expend said funds for advertising for general promotional and tourist advertising of the City and its vicin- ity, and conducting a solicitation and operating program to attract conventions and visitors to the City. The Chamber of Commerce further agrees to submit a semi-annual budget to said City re~uesting funds available from the revenue of said tax. Such budget presentations shall include a report of activities and expenditures from previously aL~ocated funds. III. I It is hereby agreed that a tourist development committee shall be formed to serve a:3 an advisory committee to said Chamber and no funds allocated from said tax shall be expended without the advice and consent of said committee. The membership of the eommittee is agreed to be five (5) persons who shall serve for the duration of this agreement. It is specifically agreed between the parties hereto that two (2) members shall be appointed by the City Council of said City, and two (2) members shall be appointed by the Board of Directors of said Chamber. The fifth member shall be selected, by the four (4) appointees. The City Manager of said City and the Manager of said Chamber shall be ex-officio members of the Committee. IV. The term of this contract shall be one' '(1) year from the date of execution by . both parties. It is expressly agreed that either party may cancel this agreement by tendering written notice to the other. Upon the expiration of thirty (30) days from the date of said notice, this agreement shall become null and void. Any funds allocated to said Chamber by said City which are unencumbered or unexpended shall be remitted to said City on or before the expiration of the thirty (30) day period.
