<br />ORDINANCE NO. 1976 - 37 <br /> <br />150 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING THE PRICE AND TERMS AND CONDITIONS OF THE <br />SALE BY THE CITY OF SAN MARCOS, TEXAS OF PARCEL NO. l3D-9, <br />DESCRIBED FURTHER ON EXHIBIT "A" ATTACHED HERETO., LOCATED <br />WITHIN THE TEX. A-6, NEIGHBORHOOD DEVELOPMENT PROGRAM AREA, <br />TO MICHAEL SAUCEDO, AUTHORIZING THE MAYOR TO EXECUTE A <br />WARRANTY DEED TO MICHAEL SAUCEDO, AND DECLARING AN EMERGENCY. <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos, Texas advertised for bids for the sale of that <br />certain real property known as Parcel No. 13D-9, and described more fully on <br />Exhibit "A" attached hereto, located within the Tex. A-6, Neighborhood Develop- <br />ment Program area, in the San Marcos Record, a local newspaper with a'general <br />circulation within the County of Hays, State of Texas; and, <br /> <br />WHEREAS, pursuant to said advertisement, a bid was submitted bt Michael Sauceuo <br />for said Parcel No. 13D-9; and <br /> <br />WHEREAS, the said bid met the minimum disposition price set up~n said property <br />by the Board of Connnissioners of the Urban Renewal Agency of the City of San <br />Marcos, Texas; and <br /> <br />WHEREAS, the said Board accepted the bid as the highest and b:st.responsible <br />bid for said property by a Resolution duly passed on December 7, 1976, after <br />the bid opening of December 7, 1976; and <br /> <br />WHEREAS, said Resolution also approved the terms and conditions for the 'sale <br />of the said property and recommended the approval of said purchase price and <br />the approval of the terms and conditions for the sale, as contained in the bid <br />documents, by the City Council of the City of San Marcos, Texas; ,and <br /> <br />I <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and the <br />sales terms and conditions pertinent thereto conform to the Redevelopment Pl;~ <br />for the Tex. A-6, Neighborhood Development Program, and conform to the Plan for <br />the development of the City as a whole; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That the terms and conditions of the sale by the City of San Marcos, <br />Texas of Parcel 13D-9, within the Tex. A-6, Neighborhood Development PrograJI, area, <br />and more fully described on Exhibit "A" attached hereto, to Michael Saucedo <br />are hereby approved. <br /> <br />Section 2. That the consideration for the sale for $2,694.00 for 9, 000 s~uare feet <br />is hereby approved. <br /> <br />Section 3. That the sale by the City of San Marcos is made subject to restrictions <br />of the Redevelopment Plan for the Tex. A-6, N.d:ghborhood Development Program, as <br />approved and amended; said Plan is on file and is available for inspection in <br />the Office of the Director of Community Development of the City of San Marcos. <br /> <br />Section 4. That the conditions of the disposition documents, including the <br />Deed and Contract of Sale for Private Redevelopment, are on file and are avail- <br />able for inspection in the Office of the Director of Community Development of the <br />City of San Marcos. <br /> <br />Section 5. That the purchaser is hereby placed on notice that the subject <br />property is subject to assessment under the provisions of Article 1105b of the <br />Revised Civil Statutes of the State of Texas. <br /> <br />I <br /> <br />Section 6. That the Mayor of the City of San Marcos is hereby authorized to <br />execute a warranty deed to Michael Saucedo, from the City of San Marcos, for all <br />that real property known as Parcel No. 13D-9, located within the Tex. A-6, <br />Neighbobhood Development Program, and described more fully on Exhibit "A" <br />attached hereto. <br />
