180-j Section C. Preliminary Plat. The subdivider shall cause to be prepared a preliminary plat, by a surveyor or engineer, of unplatted land which a subdivider expects to develop within two (2) years of the submission of said preliminary plat in accordance with Article VI, Section B, herein. Section D. Submission of Preliminary Plat. I A preliminary plat of the proposed subdivision shall first be submitted to the Commission for approval before the preparation of the final plat. Twelve (12) copies of the plat shall be tendered with a letter of transmittal to the Director of Public Works at least ten (10) days prior to the meeting of the Plat Review Committee at which time the plat is to be considered. Such plat shall be accompanied by a fee of Twenty Dollars ($20.00) per plat, plus One Dollar ($1.00) per lot. The fee shall be Twenty Dollars ($20.00) per plat, plus Five Dollars ($5.00) per acre for multi-family dwelling areas, commercial or industrial areas, and other areas not subdivided into lots. Fee is nonrefundable; however, credit will be given to a subdivider, subject to modifi- cations made to plat receiving disapproval,upon submission of preliminary plat. Section E. Processing of Preliminary Plat. 1. The Director of Public Works shall review the preliminary plat as ~o its conformity with this Ordinance. 2. The Director of Public Works shall transmit copies of the preliminary plat to the Plat Review Committee and to all utility companies which may be affected and to county departments when the site to be subdivided is located outside the City Limits, for review and recom- mendation in relation to specific service problems. I 3. The Plat Review Committee shall render a decision on the preliminary plat within ten (10) days after. its submission to the Plat Review Committee, unless such time is extended by agreement of the subdivider or his agent. Such decision may consist of approval; disapproval, or ~onditional approval. Conditional approval shall be considered to be approval subject to conformity with conditions prescribed by the Plat Review Committee, but shall be deemed to be a disapproval of such preliminary plat until such condi- tions are met, as verified by the,Director of Public Works. All objections made to the preliminary plat, or conditions imposed, shall be furnished to the subdivider in writing. Disapproval of the preliminary plat will require the subdivider to re-submit the plat in accordance with paragraph 3 of this section, or to appeal in writing to the Commission, with a copy to the City Manager, within sixty (60) days after receiving disapproval. 4. The Plat Review committee shall submit the preliminary plat to the Commission with its.recommendation. I 5. The Commission shall render a decision on the preliminary plat within thirty (30) days after submission by the Plat Review Committee, unless such time is extended by agree- ment of the subdivider or his agent. Such decision may consist of approval, disapproval, or conditional approval. Conditional approval shall be considered to be approval subject to conformity with conditions prescribed by the Commission, but shall be deemed to be a disapproval of such plat until such conditions are met, as verified by the Director of Public Works.
