I I , 42 RESOLUTION NO. 1975-28-R A RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AND ACCEPTING A CORRECTION WARRANTY DEED FROM THE URBAN RENEWAL AGENCY OF THE CITY OF SAN MARCOS OF CERTAIN DIS- POSITION PARCELS LOCATED WITHIN NDP PROJECT TEX. A-6. W,HEREAS, by a Warranty Deed dated the 6th day of November, 1972, the Urban Renewal Agency of the City of San Marcos conveyed Disposition Parcels lA-2, 4-1A, and Il-lB in the City of San Marcos and the City accepted said Warranty Deed by its Ordi- nance No. 1972-38, Passed and Approved the 27th day of November, 1972; and WHEREAS, the City requested of Agency ~hat certain corrective action be taken specifically with regard to Disposition Parcel lA-2 as referred to in the original Deed, namely, to-wit: that a portion of said Disposition Parcel lA-2, as described in the above-referenced Warranty Deed be dedicated to the City for public and semi-public use in accordance with the Urban Renewal Plan and that only the remaining portion of said parcel necessary for the construction of the Police and Courts Building be conveyed to the City; and WHEREAS, City and Agency have agreed upon said corrective action and to the terms of the purchase of that portion of Disposition Parcel lA-2 to be used for the Police and Courts Building site as set forth in the Fourth Amended Cooperation Agreement; and WHEREAS, it is necessary for Agency to execute and deliver a correction warranty deed to the City to delete a portion of Dis- position Parcel lA-2 from the Warranty Deed; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Section 1. The Correction Warranty Deed from the Urban Renewal Agency of the City of San Marcos, Texas, to the City of San Marcos foxpul:;llic and semi-public use conveying Disposition Parcels 4-1A and Il-lB and the revised Disposition Parcel lA-2, located with the NDP project Tex. A-6 and more particularly described within said Deed, is hereby accepted in place of the original warranty Deed dated the 6th day of November, 1972, and accepted by Ordinance No. 1972-38, Passed and Approved the 27th day of November, 1972.
