I I J ~: 55-a STATE OF TEXAS X COUNTY OF HAYS X RESTRICTIVE COVENANTS KNOW ALL ~N BY TRESE PRESENTS: That the City of San Marcos a municipal corporation under and by the laws of the State of Texas, of the County of Hays and the State of Texas, as the o,.ner of the hereinafter described tract of land, as eyidenced by deed recorded Volume of the , Page Hays County Deed Records, acting by and through its duly elected Mayor, Emmie Craddock, pursuant to the Resolution adopted bv the San Marcos City Council on the 16th day of June, 1975, does hereby establish and impress the following restrictions upon the said hereinafter described tract of land: 1. There shall be no sale, lease, mortgaging, or creation of other indebtedness or other transfer of any of said hereinafter described tracts of land or of any interest the City of San Marcos may have therein: and 2. The City of San l1arcos covenants and agrees to use the herein described property for park and recreation purposes only and for no other purpose whatsoever; and 3. Said restrictions and covenants are hereby declared to be a covenant running with the land and shall not be revoked unless prior consent and approval is granted by the Secretary of the Bousing and Urban Development or her successors or interests. The tract of land hereby restricted constitutes a parcel of the project NDP Tex. A-6, and is described in reference bv parcel number as follows: Parcel 11-1: Being 7.0212 acres of land located partly in the Katy Addition to the To.m of San Marcos, Bavs County, Texas, plat or map of said addition being of record in Volume 34 on Page 117 of the Deed Records of nays County, Texas and partly in the Rio Vista Park Addition to the Town of San Marcos, Rays County, Texas, plat or map of said suhdivision being of record in Volume 142 on Page 331 of the Deed Records of Hays County, Texas, said 7.9212 acres of land being more particularly descrihed by metes and hounds as follows: COMMENCING at the intersection of the east. right-of-way line of Northcraft Street, based on widtv of 60.00 feet, with the north right-of-way line of Cheatham Street, based on a width of 50.00 feet; THENCE North 80 deg. 40 min. 36 sec. East, along the north right-of-,,,ay line of Cheatham Street, a distance of 160.00 feet to the PLACE OF BEGINNING of the hereinafter described tract:
