<br />AN ORDINANCE APPROVING THE PRICE AND CONDITIONS OF THE
<br />SALE BY THE URBAN RENEWAL AGENCY OF THE CITY OF SAN MARCOS,
<br />TEXAS, OF PARCEL NO. 13D-6 (SEE LEGAL READING), LOCATED
<br />WITHIN THE JUAN 'VER.A.MENDI PROJECT, N. D. P ., TEX. A-6,
<br />TO AL LOPEZ, SOLE PROPRIETOR; AND DECLARING AN EMERGENCY.

<br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Texas, advertised
<br />for bids for the sale of certain property available for disposition within its
<br />Juan Veramendi Urban Renewal Project, N.D.P., Tex, A-6, in the San Marcos Record,
<br />a local newspaper with a general circulation within the City of San Marcos,
<br />Hays County, Texas; and,
<br />
<br />WHEREAS, pursuant to said advertisement there was a bid submitted by Al Lopez for
<br />all of Parcel No, 13D-6 within said project; and,
<br />
<br />WHEREAS, the said bid met the minimum disposition price set upon said property
<br />by the Agency; and,
<br />
<br />WHEREAS, said bid was accepted by the Board of Commissioners of the Urban Renewal
<br />Agency of the City of San Marcos, Texas, after the bid opening of August 4, 1975,
<br />and by a Resolution duly passed on August 4, 1975; and,
<br />
<br />WHEREAS, said Resolution authorizes sale to Al Lopez and recommends the acceptance
<br />and approval of the terms and conditions of the sale to the City Council; and,
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and its
<br />terms and conditions conform to the Redevelopment Plan for the Juan Veramendi
<br />Project, N .D,P., Tex. A-6, and conform to the plan for the development of the City
<br />as a whole; now, therefore,

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXA.S, THAT:

<br />l. The price and conditions of the sale of the Urban Renewal Agency of the City
<br />of San Marcos, Texas, of Parcel No, 13D-6 within the Juan Veramendi Project,
<br />N.D.P., Tex. A-6, to Al Lopez is hereby approved in accordance with Section II
<br />of Article l269l-3, Vernon's Annotated Civil Statutes of Texas.
<br />
<br />2. The property to be sold as authorized in paragraph 1 above is more particularly
<br />described by field notes attached hereto and marked as Exhibit "A" of this
<br />Ordinance.
<br />
<br />3. The consideration for said sale being a total amount of $1,900.00 is also
<br />hereby approved.
<br />
<br />4. The sale by the Urban Renewal Agency is made subject to the restriction of
<br />the Redevelopment Plan for the Juan Veramendi Project, N.D.P., Tex. A-6,
<br />as approved and amended and on file in the office of the City Secretary.
<br />
<br />5. The condition of the disposition documents, including the Deed and Contract
<br />for Sale of-Land for Private Redevelopment, a copy of which is on file in the
<br />office of the City Secretary.

<br />6. The importance of this Ordinance creates an emergency and an imperative purpose
<br />necessary that the provision of the Charter requiring that all Ordinances be read
<br />at three separate meetings and that no Ordinance shall become effective until
<br />the expiration of 10 days following the date of its final passage, be suspended,
<br />and this provision is hereby suspended, and this Ordinance shall take effect and
<br />be in force f~om and after its adoption, and publication in a newspaper of general
<br />circulation within the City.
