<br />. <br /> <br />. <br /> <br />~'h <br />, <br /> <br />LEASE <br /> <br />I <br /> <br />COUNTY OF CALDWELL <br /> <br />~. <br />r <br />I <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />THE STATE OF TEXAS <br /> <br />WHEREAS, the City of San Marcos is the owner of the San Marcos <br />(Gary) Airport, by virtue of an indenture from the United States of <br />America dated the 14th day of February, 1966, and the 14th day of July, <br />1969, to which reference is hereby made and by such reference made a <br />part hereof; and, <br /> <br />WHEREAS, the Cen-Tex Aviation Company of San Marcos, Texas, is a <br />company engaged in aeronautical services as regards business and private <br />aircraft (hereinafter referred to a.s general aviation rather than to <br />military aviation or commercial air carrier); and, <br /> <br />WHEREAS, the City of San Marcos, in order to effectuate use of the <br />subject premises for airport purposes desires to enter into a lease of <br />a portion of such airport with the Cen-Tex Aviation Company for the <br />conduct of non-e~clusive and non-discriminatory operation, as well as <br />the conduct of the aeronautical development of general aviation on the <br />airport property, and Cen-Tex Aviation Company does desire to lease <br />such property all in accordance with the following terms and conditions: <br /> <br />11. <br /> <br />~.!.!!!.~~~~!!i <br /> <br />Federal Aviation Administration. <br /> <br />All covenants, terms and conditions of this lease must be approved <br />by the Federal Aviation Administration before the effective date <br />of lease as hereinafter stipulated. <br /> <br />2. Demised Premises. <br /> <br />The City of San Marcos, hereinafter called Lessor, hereby leases to <br />Cen-Tex Aviation, hereinafter called Lessee, and said Lessee rents <br />from Lessor those certain premises described in attached e~hibits <br />and further identified thereon as Tract "A". Lessor agrees to have <br />an exact survey made of said premises, and both parties agree that <br />these surveys will be made a part of this agreement. <br /> <br />3. <br /> <br />Care of Premises. <br /> <br />I <br /> <br />That Lessee shall take good care of said premises, improvements <br />and fixtures, and suffer no waste; and shall, at Lessee's own cost <br />and expense keep the plumbing work, closets, pipes and fixtures <br />belonging thereto in good repair; and shall, except as hereinafter <br />provided, repair and replace in as good condition as when delivered <br />to him, said premises, improvements, and fixtures when damaged by <br />Lessee, any employee, representative, invitee or licensee of <br />Lessee, or any trespasser, same to be done at Lessee's own cost and <br />e~pense, reasonable wear and tear, and damage from windstorm or <br />fire, or any other act of God excepted; all alterations, additions <br />and improvements, except trade fixtures made or placed in or upon <br />said premises at the e~pense Qf Lessee shall become the property <br />of the Lessor, and shall remain upon and be surrendered to Lessor <br />with the premises, as a part thereof, upon the termination of this <br />lease; but Lessee shall make no alteration without the written <br />consent of Lessor. <br /> <br />\J <br />
