<br />I <br /> <br />I <br /> <br />I <br /> <br />. <br /> <br />. <br /> <br />D. 'Air Charter and Air Taxi Service. <br /> <br />Must have the following minimum requirements: <br /> <br />1. Personnel. One Federal Aviation Administration commercial <br />pilot who is appropriately rated to conduct air taxi <br />service. <br /> <br />2. Aircraft. One four-place aircraft meeting all the require- <br />ments of the Air Taxi/Commercial Operator Certificate held. <br /> <br />3. Hours of Operation. The hours of operation shall be from <br />B:OO A.M. to 5:00 P.M., six days a week. <br /> <br />4. Insurance. Same as required under aircraft sales. <br /> <br />5. Licenses. Must hold a Federal Aviation Administration <br />Operator Certificate with ratings appropriate to the <br />function to be accomplished. <br /> <br />,&. Term of Lease. <br /> <br />The term of this lease for the property heretofore described in <br />paragraph 2 shall be for a term of five (5) years beginning Janu- <br />ary 1, 197&, and running through December 31, 19BO <br /> <br />7. <br /> <br />Use of Airport Facilities. <br /> <br />During the term of this lease, the Lessor agrees t~at Lessee shall <br />have unrestricted access to the runways and taxi-ways now in <br />existence on the San Marcos Municip~l Airport to the same extent <br />that,any other parties may. have use thereof, subject to reasonable <br />rules and regulations and non-discriminatory charges that may be <br />imposed for use of the airport facilities by the Lessor, the Federal <br />Aviation Administrator, or any other governmental entity having <br />jurisdiction or control over the use of such airport.fa.cility. It <br />is expressly understood and agreed that Lessee ,has the exclusive <br />right to use only those aircraft tie-down positions on the concrete <br />ramp or apron directly in front of his leased property, extending <br />out 250' from the demised property, for his own aircraft,f It is <br />understood and agreed by and between the parties hereto that the <br />continuing use of the San Marcos Municipal Airport as an airport for <br />general aviation is essential to the operation of Lessee .and that <br />failure to continue the use of the airport for airport and aviation <br />purposes shall constitute a default in the lease agreement; and <br />upon giving notice by Lessee to Lessor of such default and failure <br />to cure such default within thirty (30) days after the giving of <br />such notice, this lease shall terminate and end as of the date <br />120 days after such notice shall have been given; and Lessee shall <br />thereupon be released from and relieved of all further obligations <br />thereafter to accrue hereunder. <br /> <br />8. <br /> <br />Maintenance. <br /> <br />Maintenance of the runways, taxi-ways, entrance roads, driveways, <br />existing parking lots, leading to and/or contiguous to the demised <br />property, and unoccupied property of the San Marcos Municipal <br />Airport except for the premises demised and leased by Lessee, <br />shall remain the obligation of the Lessor; PROVIDED, HOWEVER, that <br />Lessor shall only be obligated to use airport revenue funds for <br />such purposes and it shall never have the obligation to use general, <br />operating or bond funds for this purpose. <br /> <br />9. <br /> <br />Covenants of Lessor. <br /> <br />Lessor agrees that all airport revenue derived from Lessee and <br />any other user of the property should be allocated toward the <br /> <br />-3- <br />
