<br />99-a <br /> <br />Section 15.2. Temporary Use of Land by Mobile Homes. <br /> <br />A mobile home, as that term is defined in Section 4 of this Ordinance, may <br />be placed temporarily in any zoned district provided the following requirements <br />are first satisfied. <br /> <br />1. Compliance with all pertinent prOV1S1ons of the Minimum Housing, Building, <br />Plumbing and Electrical Codes, as presently in force or hereafter amended, of <br />the City of San Marcos. <br /> <br />2. All applications for a permit to temporarily place a mobile home upon a I <br />certain tract of land shall be made by the owner of the land which is the subject <br />of the application and shall be processed in the same manner as applications for <br />changes of zoning, as provided in Section 2 of this Ordinance. Under no circum- <br />stances shall a temporary mobile home permit be issued to any person other than <br />the owner of land in question, nor to any owner already holding two such permits for <br />the land in question. If no opposition to the location of a trailer house is made <br />by an owner of land within two hundred (200) feet in each direction of the tract upon <br />which the applicant wishes to place the mobile home, the Planning and Zoning <br />Commission may recommend to the City Council that a permit be granted to temporarily <br />locate a mobile home upon the designated tract of land. Such permit shall not be <br />granted for a period in excess of twent~-four (24) months. If opposition to the <br />location of a mobile home is made by any owner of land within two hundred (200) <br />feet in each direction of the tract upon which the applicant wishes to place the <br />mobile home, such application shall be denied. <br /> <br />3. If the holder of a permit to temporarily place a mobile home upon a certain <br />tract of land desires the extension thereof, he shall make application for such <br />extension a minimum of thirty (30) days prior to the expiration date of the original <br />permit. An application for an extension of a permit shall be processed in the <br />same manner a~ applications for the original permits. <br /> <br />4. For each public hearing held in connection with any original or extension <br />permit application, a fee of Twenty-five Dollars ($25.00) shall be paid by the <br />applicant to the City of San Marcos. toward the discharge of the expenses of such I <br />hearing. <br /> <br />5. Upon the giving of notice of opposition by the owner or owners of property <br />within two hundred (200) feet of the proposed location of the mobile home, the <br />owner of the mobile home, or the owner of the land upon which same is located, or <br />both, shall remove said mobile home within sixty (60) days of his or their receipt <br />of such notice. Failure to remove the mobile home following receipt of such notice <br />shall constitute a violation of this Ordinance. <br /> <br />6. A permit to locate a mobile home may be revoked by majority action of <br />the City Council of the City of San Marcos. Following any such revocation, the owner <br />of the mobile home, or the owner of the land upon which same is located, or both, <br />shall remove said mobile home within sixty (60) days of his or their receipt of <br />such notice. Failure to remove the mobile home following receipt of such notice <br />shall constitute a violation of this Ordinance. <br /> <br />7. Any permit issued under the terms of this Oridnance shall not be transfer- <br />able to any person or persons. <br /> <br />8. In the event that there are restrictions of record in the office of the <br />County Clerk of Hays County, Texas, which prohibit the location of a mobile home upon <br />the land where the applicant desires to place same, no permit shall be issued. <br /> <br />9. All applications for the temporary location of a mobile home shall <br />contain at least the make, year, model, floor area, and condition of the mobile I <br />home. <br />
