AMENDED COOJ;lERATION AGREEMENT <br /> <br />STATE OF TEXAS S <br />COUNTY OF HAYS S <br /> <br />THIS ~OURTH AMENDEDCOOJ;lEMTION AGRE~, m..de and ent.ered <br />into this 0#1 day of .Lf1l ~ . . . , 1974, by and between the <br />URBAN RENEWAL AGENCY OF THE In OF SAN MARCOS, TEXAS (hereinafter <br />referred t.o as the "Agency.), and the CITY OF SAN MARCOS, TEXAS, <br />a municipal corporat.ion (hereinafter referred t.o as the "CITY") , <br />supersedes and amends the Cooperation Agreement. previously entered <br />into between the parties on the 11th day of June, 1973, as follows: <br /> <br />WHEREAS, the Agency is a public body co~orate and pOlitic, <br />created by the laws of the state of Texas pertaining thereto, <br />specifically, ~ised Civil Statutes of Texas, 1925, Article <br />1269 L-3, and is transacting business and exercising the powers <br />granted by said law; and <br /> <br />WHEREAS, the Agency w!th the aid and cooperation of the City <br />proposes to undertake and carry out .. Neighborhood Development <br />Program in the City of San Marcos, Texas, in accordance with the <br />Urban Renewal Plan therefore approved by the City council, and <br />bearing date of July 1, 1969, as amended by Minor Amendment No. <br />1 and 2, and pursuant to the proviSions of the laws of the State <br />of Texas as hereinabove referred to; and <br /> <br />WHEREAS, the Agency proposes to enter into a Loan and Grant <br />Contract with the Department of Housing and Urban Development, <br />an agency of the United states of America, providing for financial <br />assistance pursuant to Title I of the Housing Act of 1949, as amended, <br />for the purpose of carrying out the provisions of the Urban Renewal <br />Plan, as follows: <br /> <br />(1) A loan in the amount sufficient to en..ble it to <br />defray the gross cost of the Project, but not exceeding <br />$1,939,904.QO <br /> <br />(2) A Project Capital Grant in the maximum amount <br />available for the Project ($1,062,602..00); <br /> <br />(3) A relocation grant in the maximum amount available <br />for the Project ($0.00); and <br /> <br />WHEREAS, the City desires to provide "Local Grants-in-Aid" in <br />connection with said project and has heretofore indicated its <br />intention to do so in a resolution approving said Urban Renewal Plan <br />for said Neighborhood Development Program; <br /> <br />NOW, THEREFORE, in consideration of the mutual covenants <br />hereinafter set forth, the Agency and City agree as follows: <br /> <br />1. <br /> <br />AGENCY <br /> <br />(a) The Agency agrees (1) to carry out ..nd fulfill <br />the proposed Loan and Grant Contract specifically <br />between it and the United States of America, act.ing <br />by and through the Secretary of Housing and Urban <br />Development; and (2) to proceed diligently and <br />forthwith with all necessary actions, works, and <br />undertakings to carry out the proposed and approved <br />Neighborhood Development Program in the following <br />described areas: <br />
