AMENDED COOJ;lERATION AGREEMENT STATE OF TEXAS S COUNTY OF HAYS S THIS ~OURTH AMENDEDCOOJ;lEMTION AGRE~, m..de and ent.ered into this 0#1 day of .Lf1l ~ . . . , 1974, by and between the URBAN RENEWAL AGENCY OF THE In OF SAN MARCOS, TEXAS (hereinafter referred t.o as the "Agency.), and the CITY OF SAN MARCOS, TEXAS, a municipal corporat.ion (hereinafter referred t.o as the "CITY") , supersedes and amends the Cooperation Agreement. previously entered into between the parties on the 11th day of June, 1973, as follows: WHEREAS, the Agency is a public body co~orate and pOlitic, created by the laws of the state of Texas pertaining thereto, specifically, ~ised Civil Statutes of Texas, 1925, Article 1269 L-3, and is transacting business and exercising the powers granted by said law; and WHEREAS, the Agency w!th the aid and cooperation of the City proposes to undertake and carry out .. Neighborhood Development Program in the City of San Marcos, Texas, in accordance with the Urban Renewal Plan therefore approved by the City council, and bearing date of July 1, 1969, as amended by Minor Amendment No. 1 and 2, and pursuant to the proviSions of the laws of the State of Texas as hereinabove referred to; and WHEREAS, the Agency proposes to enter into a Loan and Grant Contract with the Department of Housing and Urban Development, an agency of the United states of America, providing for financial assistance pursuant to Title I of the Housing Act of 1949, as amended, for the purpose of carrying out the provisions of the Urban Renewal Plan, as follows: (1) A loan in the amount sufficient to en..ble it to defray the gross cost of the Project, but not exceeding $1,939,904.QO (2) A Project Capital Grant in the maximum amount available for the Project ($1,062,602..00); (3) A relocation grant in the maximum amount available for the Project ($0.00); and WHEREAS, the City desires to provide "Local Grants-in-Aid" in connection with said project and has heretofore indicated its intention to do so in a resolution approving said Urban Renewal Plan for said Neighborhood Development Program; NOW, THEREFORE, in consideration of the mutual covenants hereinafter set forth, the Agency and City agree as follows: 1. AGENCY (a) The Agency agrees (1) to carry out ..nd fulfill the proposed Loan and Grant Contract specifically between it and the United States of America, act.ing by and through the Secretary of Housing and Urban Development; and (2) to proceed diligently and forthwith with all necessary actions, works, and undertakings to carry out the proposed and approved Neighborhood Development Program in the following described areas:
