149-a THENCE, S. 45017' E. 128.33 feet to the Place of Beginning, containing 0.28 acres of land; and, WHEREAS, said dedication of an extension of Pegues Street was not accepted by the County of Hays or the City of San Marcos, nor has the County of Hays or City of San Marcos ever exercised, nor is either of them now exercising any jurisdiction over any part of said 0.28 of an acre so dedicated by H.A. Nelson and wife, and no portion of same I has ever been graded, graveled, paved nor in anywise used by the public as a passageway, nor has the said 0.28 of an acre ever been used by the County of Hays or the City of San Marcos'or the public for any purpose; and, WHEREAS, Hugh A. Nelson, Jr., Marian Nelson Meeks and Reuben H. Meeks are the owners of all the land on both sides of said 0.28 of an acre as an extension of Pegues Street to Bluebonnet Drive, and the said Hugh A. Nelson, Jr., Marian Nelson Meeks and Reuben H. Meeks have petitioned the City of San Marcos to close and abandon said 0.28 of an acre of land as an extension of Pegues Street, and have further petitioned the City of San Marcos to quitclaim said extension of Pegues Street to them: NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY I COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: (1) All of the above mentioned 0.28 of an acre of land as an extension of Pegues Street be, and it is hereby abandoned, vacated, discontinued and closed as a public street; (2) That the City of San Marcos relinquishes hereby to the said Hugh A. Nelson, Jr., Marian Nelson Meeks and Reuben H. Meeks all right, title and interest of the City of San Marcos in and to said extension of Pegues Street to Bluebonnet Drive and further that the Mayor of the City of San Marcos is hereby authorized, empowered and directed to execute and deliver to the said Hugh A. Nelson, Jr., Marian Nelson Meeks and Reuben H. Meeks, quitclaim deeds to that portion of said street adjoining other real property owned by such I persons, such deeds to be executed and delivered in the due and usual form by the Mayor and City Secretary, in their respective capacities, and with the seal of the City of San Marcos and attestation of the City Secretary affixed and shown thereon.
