<br />I <br /> <br />I <br /> <br />I <br /> <br />~ <br /> <br />152 <br /> <br />ORDINANCE NO. 1974 - 28 <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THAT CERTAIN ORDINANCE <br />DATED SEPTEMBER 11, 1972, WHICH VACATED, <br />ABANDONED, AND CLOSED CERTAIN PORTIONS <br />OF ACADEMY, JAMES, NORTH, AND ALAMO <br />STREETS IN SAN MARCOS, TEXAS, AND AUTHO- <br />RIZED THE EXECUTION OF A QUITCLAIM DEED <br />FROM SAID CITY TO SAN MARCOS BAPTIST <br />ACADEMY, BY REPEALING THE LEGAL DESCRIP- <br />TION OF SAID STREETS, AND SUBSTITUTING <br />IN ITS PLACE A NEW LEGAL DESCRIPTION FOR <br />THE CLOSING AND ABONDONING OF SAID STREETS. <br /> <br />WHEREAS, the City of San Marcos has previously vacated, <br />abandoned, and closed certain portions of Academy, James, North, <br />and Alamo Streets by an ordinance dated September 11, 1972; and, <br /> <br />WHEREAS, it is the opinion of the City Council of the City <br />of San Marcos that the legal description contained in said <br />previous ordinance is vague and indefinite and should be amended; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. That the legal description which is contained in a <br />certain ordinance passed by the City Council of the City of <br />San Marcos on September 11, 1972, closing Academy, James, North, <br />and Alamo Streets be, and is hereby, in all things repealed. <br /> <br />PART 2. That a new legal description be, and is hereby, <br />inserted for the purpose of clarity to facilitate the drafting <br />and execution of a quitclaim deed to San Marcos Baptist Academy, <br />said new legal description of said streets to read as follows: <br /> <br />(a) Beginning at a line which is a southwesterly projection <br />of the southwest right-of-way line of Cornell Street, said pro- <br />jection beginning at the west corner of Lot 1 of the McNaughton <br />Addition, plat of record in Volume 55, page 593, Hays County <br />Deed Records, and ending on the southwest line of Academy Street; <br />Thence, in a southeasterly direction, with and including the <br />width of the entire Academy Street right-of-way, approximately <br />1130 feet to a point at Lot 3 of said J.R. Pentuff Second Addi- <br />tion, plat of record in Volume 58, page 394, Hays County Deed <br />Records, same point being approximately 26 feet southeast of <br />the Northwest corner of Lot 3 of said addition. <br /> <br />(b) Beginning at a line which is an extension of the north- <br />east line of Academy Street, which line begins at the south <br />corner of the J.R. Pentuff First Addition, plat of record in <br />Volume 58, page 395, Hays County Deed Records, and crosses <br />James Street to a westerly corner of a tract of land owned by <br />the San Marcos Baptist Academy; Thence, in a northeasterly direc- <br />tion, with and including the width of the entire right-of-way <br />of James Street, approximately 352 feet to the end of James <br />Street where it joins North Street. <br /> <br />(c) Beginning at a line which is a northeasterly projection <br />of the southeast line of James Street, which line begins at a <br />northerly corner of a tract of land owned by the San Marcos <br />Baptist Academy, and ends on the northeast line of North Street; <br />Thence in a southeasterly direction, with and including the <br />width of the entire right-of-way of North Street, approximately <br />340 feet to a point at Lot 7 of said J. R. Pentuff Second Addi- <br />tion, said point being approximately 30 feet southeast of the <br />southeast corner of Lot 6 of said addition. <br />
