<br />l7 <br /> <br />ORDINANCE NO. 1974 - 39 <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THAT CERTAIN ORDINANCE <br />DATED MARCH 8, 1971, ESTABLISHING A <br />BOARD TO ADVISE THE CITY COUNCIL AND THE <br />CITY ADMINISTRATIVE STAFF IN MATTERS <br />CONCERNING THE ENVIRONMENT BY DELETING <br />SECTION 2 OF SUCH ORDINANCE AND ENACTING <br />A NEW SECTION NUMBERED 2 BY ALLOWING <br />MEMBERSHIP TO SUCH BOARD BY CITIZENS <br />LIVING WITHIN THE EXTRATERRITORIAL JURIS- <br />DICTION OF THE CITY. <br /> <br />I <br /> <br />WHEREAS, the City Council desires to maintain the <br />Environmental Advisory Committee as an active board dealing with <br />the environment; and, <br /> <br />WHEREAS, the City Council desires to allow citizens living <br />outside of the City but within its extraterritorial jurisdiction <br />of one mile to serve as member of Said Board; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the ordinance creating the powers, duties, <br />and functions of the Environmental Advisory Committee dated March 8, <br />1974, be and is hereby amended, by deleting and repealing Section 2 <br />of said ordinance and enacting a new Section 2 so as to read as <br />follows: <br /> <br />I <br /> <br />"Section 2. The Environmental Advisory Committee shall <br />consist of seven (7) members. Two of these members shall <br />be the City Health Officer and the City Veterinarian, <br />and the five remaining members shall be appointed by the <br />Mayor with the advise and consent of the City Council. <br />Of the five members to be appointed by the Mayor, one (1) <br />member may be a citizen of Hays County residing within <br />the extraterritorial jurisdiction of the City as estab- <br />lished by Article 970a, Revised Civil Statutes of Texas <br />(1925), now and as hereinafter amended. All remaining <br />appointees to the Committee shall be citizens of said City. <br />Members of the Committee shall serve for a term of two (2) <br />years, beginning April 1, 1971. The Members of the Environ- <br />mental Advisory Committee receive no compensation for their <br />services except as authorized by the City Council." <br /> <br />SECTION 2. This ordinance shall become effective ten (10) <br />days from and after final passage by the City Council. <br /> <br />PASSED AND APPROVED on first reading June 10, 1974. <br />PASSED AND APPROVED on second reading July 8, 1974. <br /> <br />PASSED, APPROVED AND <br /> <br />ADOP~.
