Elwell, AdministratiVe~ASsistant~¢~v <br /> <br />~UBJECT: Cemetery Problems <br /> <br />DATE: December 31, 1980 <br /> <br />RE: Cemetery Correspondence <br /> <br />Some time ago a gentleman came to inquire about purchasing some cemetery <br />spaces near his family's property in the Old Original Addition. I told <br />him that all the spaces in that area had been sold years ago. He then <br />asked if it were possible to purchase the walkway adjoining ~.th~ family's <br />spaces. Since I have been working with the City, I asked Doriss Hambrick <br />what the answer to such a request is normally. Doriss said that during <br />the time she was responsible for the Cemetery, this request had been made <br />many times. She said it had always been refused. <br /> <br />When I gave this information to the gentleman, he asked to see you. <br />discussing the manter with him, you refused his request as well. <br /> <br />After <br /> <br />It is my understanding that the gentleman has made his request to members <br />of the Council. I would like to point out some problems that will be <br />realized if this request is approved: <br /> <br />The most obvious result of granting of the request could be a sudden <br />clamor from the many persons who had made the same request and been <br />refused in the past. These people may fee%--~hey are being unfairly <br />treated and could demand to purchase areas in the easements to their <br />property. Council may be flooded with similiar entreaties, and if <br />they grant one, will they not have to grant all? <br /> <br />Development of the Cemetery could proceed without plan or design, <br />destroying its esthetic quality. Also, some persons may complain <br />that they curbed their lots too early, never realizing that the City <br />would consider allowing development in the easement. <br /> <br />This particular request concerns spaces adjacent to a fence; therefore, <br />the placement of gravesites in the easement will not hinder access <br />to other sites. However, the next request will most likely not be in <br />such a location. If access to other spaces is hindered by selling <br />gravesites in easements, legal problems can surface. <br /> <br />If one property owner makes a request to purchase an easement and the <br />request ~s granted, the owner of the property abutting the easement <br />in question may feel that he is entitled to one half of the easement. <br />Or he may simply feel that he deserves an equal opportunity to pur- <br /> <br />CSM~I O0 <br /> <br /> <br />
