AN ORDINANCE BY THE CITY OF KYLE, TEXAS, DESCRIBING THE FUNCTIONS, DUTIES, I\ND POWERS OF SHELTER MANAGERS DURING NATIONAL ENERGENCIES; PROVIDING A PENALTY; I\ND DECLARING I\N E}llffiGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KYLE, TEY.AS: Section 1. In case of national emergency, Public Shelter Managers duly I appointed by the civil Defense Director, shall open public shelters, take charge of all stocks of food, water, and other supplies stored in said shelter, admit the public according to the city's shelter use plan and take whatever control measures are necessary for the protection and safety of the occupants. Section 2. Shelter Managers are authorized to use reasonable restraint against those who refuse to cooperate with the routine of sh<;>lter living under emergency conditions. Refusal to carry out the orders of the Shelter Manager and his appointed staff shall be deemed a misdemeanor punishable by ... . a fine of not more than Two Hundred Dollars ($200.00). Section 3. The fact that there is presently no authorization of powe.r for Shelter Managers during a national emergency in the City of Kyle, and the fact that such regulations are needed for the protection of the safety and I welfare of the citizens of the city of Kyle during a national emergency, creates an emergency and an imperative public necessity of the immediate preservation of the public welfare and safety which requires suspension of the rule requiring ordinances to be read on three separate days before the final passage thereof, and such rules are hereby suspended and this ordinance shall be effective from and after its final passage, and it is so ordained.
