<br />. <br /> <br />. <br /> <br />ORDIt;1ilio; I;O. <br /> <br />AN ORDINANCE BY THE CITY OF KYLE, TEXAS, DESCRIBING <br />THE FUNCTIONS, DUTIES, I\ND POWERS OF SHELTER MANAGERS <br />DURING NATIONAL ENERGENCIES; PROVIDING A PENALTY; I\ND <br />DECLARING I\N E}llffiGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KYLE, TEY.AS: <br /> <br />Section 1. In case of national emergency, Public Shelter Managers duly <br /> <br />I <br /> <br />appointed by the civil Defense Director, shall open public shelters, take <br /> <br />charge of all stocks of food, water, and other supplies stored in said shelter, <br /> <br />admit the public according to the city's shelter use plan and take whatever <br /> <br />control measures are necessary for the protection and safety of the occupants. <br /> <br />Section 2. Shelter Managers are authorized to use reasonable restraint <br /> <br />against those who refuse to cooperate with the routine of sh<;>lter living <br /> <br />under emergency conditions. Refusal to carry out the orders of the Shelter <br /> <br />Manager and his appointed staff shall be deemed a misdemeanor punishable by <br /> <br />... . <br /> <br />a fine of not more than Two Hundred Dollars ($200.00). <br /> <br />Section 3. The fact that there is presently no authorization of powe.r <br /> <br />for Shelter Managers during a national emergency in the City of Kyle, and the <br /> <br />fact that such regulations are needed for the protection of the safety and <br /> <br />I <br /> <br />welfare of the citizens of the city of Kyle during a national emergency, <br /> <br />creates an emergency and an imperative public necessity of the immediate <br /> <br />preservation of the public welfare and safety which requires suspension of the <br /> <br />rule requiring ordinances to be read on three separate days before the <br /> <br />final passage thereof, and such rules are hereby suspended and this ordinance <br /> <br />shall be effective from and after its final passage, and it is so ordained. <br /> <br />PASSED I\ND APPROVED THIS <br /> <br />DAY OF <br /> <br />,19_. <br /> <br />ATTEST: <br /> <br />City Clerk <br /> <br />Mayor, City of Kyle <br /> <br />City Attorney <br /> <br />_..._...,_.._....._,.._=-~L... <br />
