<br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING
<br />ARTICLE I OF CHAPTER 23 OF THE CODE OF ORDINANCES OF THE
<br />CITY OF SAN MARCOS BY ADDING TO SECTION 23-1 A REQUIREMENT
<br />THAT EACH CANDIDATE POST A DEPOSIT AND ADDING TO SECTION
<br />23-2 A NINETY (90) DAY LIMITATION FOR THE POSTING OF
<br />PRINTED MATERIAL.

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That Article I of Chapter 23 of the Code of Ordinances of the
<br />City of San Marcos, Texas, be, and is hereby, amended by adding to Section 23-1
<br />a re~uirement that each individual candidate post the required deposit, or,
<br />in specified cases, post partial deposit so that said Section shall read as
<br />follows:

<br />Any person, candidate for public office, organization, or
<br />business entity wishing to place circulars, handbills, posters,
<br />or any other similar printed material on utility poles within the
<br />corporate limits of San Marcos, Texas, shall post a fifty dollar
<br />($50.00) deposit with the Chief of Police. Upon receipt of such
<br />deposit, the Chief of Police shall issue to the applicant a
<br />permit to place printed materials on utility poles within the City.
<br />Such deposit is required to secure the proper performance of all
<br />conditions placed upon applicant to the terms of this Ordinance.

<br />Any person making application for a permit issued pursuant to
<br />this Section to display printed material advertising a candidate
<br />for public office shall post the deposit herein re~uired for each
<br />candidate to be advertised by such printed material, provided
<br />however, that nothing herein shall be construed so as to re~uire
<br />separate deposits of each candidate when several candidacies for
<br />public office are advertised on one circular, handbill, or poster.

<br />SECTION 2. That Article I of Chapter 23 of the Code of Ordinances of the
<br />City of San Marcos, Texas, be, and is hereby, amended by adding to Section 23~2
<br />a ninety (90) day limitation for the period for which printed material may
<br />remain on ~tility poles so that said Section shall read as follows:

<br />Wpon making application and deposit of Fifty Dollars ($50.00) with
<br />the C~ief of Police, applicant shall agree to remove all circulars, etc.,
<br />placed on utility poles within the City within forty-eight (48) hours
<br />afterlthe event, election or occurrence for which purpose the permit waS
<br />obtai ed, provided however, that under no circumstances shall printed mat
<br />material be allowed to remain on utility poles for a period of time
<br />exceeding ninety (90) calendar days. In addition to the above, applicant
<br />shall~agree to attach the circular, poster, etc., to the utility pole
<br />by us of a stapler or staple e~uipment only. Failure by applicant to
<br />compl with the above stated agreements shall be grounds for refusal to
<br />refund deposit.

<br />SECTION 3.1 That this Ordinance shall take effect ten (10) days from and
<br />after its 1inal passage.
