<br />45 <br /> <br />ORDINANCE NO. 1973 - 62 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS AMENDING CHAPTER 30, ARTICLE I, SECTION 30-7, OF THE <br />CITY OF SAN MARCOS CODE OF ORDINANCES, ESTABLISHES A NEW <br />DEPOSIT FEE FOR ALL NEW RESIDENTIAL WATER CONNECTIONS AND <br />A DEPOSIT FEE FOR ALL NEW COMMERCIAL ESTABLISHMENTS. <br /> <br />I <br /> <br />WHEREAS, the City Council of the City of San Marcos is.of the <br /> <br />opinion that the current water deposit is inadequate for the purpose <br /> <br />served; and <br /> <br />WHEREAS, the City Council is of the opinion that a new deposit <br /> <br />should be established to more adequately secure water service <br /> <br />payment; and <br /> <br />WHEREAS, the City Council is of the opinion that such action <br /> <br />is in the public interest and benefit; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br /> <br />Part 1. That Chapter 30, Article 1, Section 30-7 of the City <br /> <br />of San Marcos Code of Ordinances be, and is hereby, amended so as <br /> <br />to change the required new residential water deposit from ten <br />II dollars ($10.00) to twenty dollars ($20.00). <br />Part 2. That the provision in Section 30-7 of the City Code, <br /> <br />as previously referenced, dealing with commercial establishment <br /> <br />water deposit remain unchanged. <br /> <br />Part 3. That Section 30-7 of the City Code, as previously <br /> <br />referenced, be amended, as enumerated above, so that Section 30-7 <br /> <br />of the City Code of Ordinances shall read as follows: <br /> <br />"Section 30-7. Deposit. <br /> <br />All new residential connections for utility services <br />shall pay a twenty dollar ($20.00) deposit and all <br />commercial establishments shall pay a deposit equal to <br />one and one-half times (1.5) their estimated average <br />monthly bill." <br /> <br />I <br /> <br />Part 4. This ordinance shall become effective ten (10) days from <br /> <br />and after its final passage. <br /> <br />PASSED AND APPROVED on first reading November 26, 1973. <br /> <br />PASSED AND APPROVED on second reading December 10, 1973. <br /> <br />PASSED, APPROVED AND ADOPTED December 17, 1973. <br />
