<br />Oc <br />c:J r <br /> <br />This resolution is the same on earlier endorsed by the Hays County Indeperxlent <br /> <br />PartYI <br /> <br />I <br /> <br />Proposed Resoiliution <br /> <br />City of San Marcos. City Council <br /> <br />1. Objective I The creation of a city council appoi.n:t.ed board to be known as the <br />Rental Review Board <br /> <br />II. Rationale I Due to the fact that many hurxlreds of responsible tax paying <br />citizens of San Marcos are in the position of relying on rental <br />}lroperty for shelter. it is reasonable arxl just that they as <br />well as their larxllords have some manner of settling disputes. <br /> <br />III. Membershipl The membership of this board will be composed of five IIlembers <br />arxl two alternate members. Two members will be lan:ilords, two <br />members wi1l be tenants. arxl the fifth member will be a pri- <br />vate home owner. One alternate will be a landlord ani one al- <br />ternate will be a tenant. The alternate members will assume <br />membership in any review process where one of the prinoipal <br />board members is involved or a direct party in the dispute. <br /> <br />IV. Operation I The Board will set its own internal procedures including such <br />items as meeting dates. time, and place. <br /> <br />I <br /> <br />V. RespOl'ISibilitYI The Rental Review Board will serve as the source for land- <br />lords and tenants to bring regress of grevianoes. Such re- <br />view power will inolude the following types of grevianoes ')\,'1- <br />but not limited to just the below eJl1ll1lElrated POintSI <br />1. Unreasonable or exoessive rents <br />2. Unreasonable or excessive deposits <br />3. Claims of damage by landlord against tenant <br />4. Claims of failure to provide adequate repair of rental <br />property <br />5. Disputes over returns or retentions of deposits <br />6. Disorimination by landlords in renting to minorities <br />7. other landlord and tenant disputes that may arise. <br /> <br />VI. Enforoementl It is expected that all parties will submit disputes voluntarily <br />and accept the Board' s decision voluntarily.
