RESOLUTION 2010 -82R <br />• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE CITY MANAGER TO <br />EXECUTE RIGHT OF FIRST REFUSAL AGREEMENTS WITH TEXAS <br />STATE UNIVERSITY -SAN MARCOS AND THE TEXAS STATE <br />UNIVERSITY -SAN MARCOS SUPPORT FOUNDATION GRANTING TO <br />THE CITY THE FIRST RIGHT NEGOTIATE FOR THE ACQUISITION <br />OF TWO LOTS IN THE CENTRAL BUSINESS AREA AND GRANTING <br />TO TEXAS STATE UNIVERSITY -SAN MARCOS THE FIRST RIGHT TO <br />NEGOTIATE FOR THE ACQUISITION OF A PORTION OF A TRACT <br />OF LAND ADJACENT TO CHARLES AUSTIN DRIVE; AND <br />PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City of San Marcos wishes to secure the first right to negotiate for the <br />acquisition of certain real property owned by Texas State University -San Marcos and the <br />Texas State University -San Marcos Support Foundation located in the Central Business Area, <br />as identified in agreements attached as part of Exhibit "A ", in the event such parties ever elect <br />to dispose of such property. <br />• 2. Similarly, Texas State University -San Marcos wishes to secure the first right to <br />negotiate for the acquisition of certain real property owned by the City of San Marcos <br />adjacent to Charles Austin Drive, as identified in an agreement attached as part of Exhibit <br />"A ", in the event the City elects to and is authorized by law to dispose of such property. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. That the terms and conditions of the Right of First Refusal Agreements <br />(the "Agreements ") attached hereto as part of Exhibit "A" are hereby approved. <br />PART 2. That the City Manager, Rick Menchaca, is hereby authorized to execute <br />the Agreements on behalf of the City. <br />PART 3. That this Resolution shall be in full force and effect from and after its <br />passage. <br />• <br />
