RESOLUTION 2010 -83R <br />• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DEDICATING FIVE ACRES OUT OF THE SPRING <br />LAKE PRESERVE PARKLAND AS OPEN SPACE, AS REQUIRED BY <br />THE TEXAS PARKS AND WILDLIFE DEPARTMENT; AND <br />PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />1. In 2007 the City acquired 250.7 acres of land from the Nature Conservancy for <br />the Spring Lake Preserve. <br />2. Funding for the acquisition and establishment of the Spring Lake Preserve was <br />provided, in part, through a grant from the Texas Parks and Wildlife Department. Under the <br />terms of the grant, five acres of land is required to be dedicated as open space. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. In order to fulfill the requirements of the Texas Parks and Wildlife <br />Department's grant, the City Council of the City of San Marcos, Texas hereby designates five <br />acres out of the Spring Lake Preserve parkland, as shown in Exhibit "A ", attached hereto and <br />• made a part hereof, for open space. <br />PART 2. That the City Manager may execute such other instruments or written <br />assurances to the Texas Parks and Wildlife Department consistent with this Resolution and the <br />terms of any applicable grant agreements. <br />PART 3.
