1973 - 33 17--0 I AN ORDINANCE CLOSING THE HEARING GIVEN TO THE REAL AND TRUE OWNERS OF PROPERTY ABUTTING UPON LINDA DRIVE AND' THORP LANE IN THE CITY OF SAN MARCOS, TEXAS, WITHIN THE LIMITS HEREINAFTER DEFINED, AS TO SPECIAL BENEFITS TO ACCRUE TO SAID PROPERTY AND THE REAL AND TRUE OWNERS THEREOF BY VIRTUE OF THE IMPROVEMENT OF SAID STREETS WITHIN SAID LIMITS, AND AS TO ANY ERRORS, INVALIDITIES OR IRREGULARITIES IN ANY OF THE PROCEEDINGS OR CONTRACT THEREFOR; OVERRULING AND DENYING ALL PROTESTS AND OBJECTIONS OFFERED; FINDING AND DETERMINING THAT EACH AND EVERY PARCEL OF PROPERTY ABUTTING UPON SAID STREETS WITHIN THE LIMITS WITHIN THE LIMITS DEFINED WILL BE SPECIALLY BENEFITTED AND ENHANCED IN VALUE IN EXCESS OF THE AMOUNT OF THE COST OF SAID IMPROVEMENTS PROPOSED TO BE, AND AS, ASSESSED AGAINST SAID PROPERTY, AND THE REAL AND TRUE OWNERS THEREOF, AND LEVYING AN ASSESSMENT FOR THE PAYMENT OF A PORTION OF THE COST OF IMPROVING SAID STREETS WITHIN SAID LIMITS DEFINED; FIXING A CHARGE AND LIEN AGAINST SAID PROPERTIES, AND THE REAL AND TRUE OWNERS THEREOF; PROV I DING FOR THE MANNER AND METHOD OF COLLECT! ON OF SAID ASSESSMENTS; DECLARING AN EMERGENCY, AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY UPON ITS PASSAGE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The City Council of the City of San Marcos, Texas, finds: I (a) That the City Council of the City of San Marcos, Texas, has heretofore by ordinance duly enacted on May 29, 1973, determined the necessity for, and ordered the improvement of portions of Thorp Lane and Linda Drive in the City of San Marcos, Texas, within the I imits therein defined, and in the manner and according to the plans and specifications therefor, which plans and specifi- cations have heretofore been approved and adopted by said City Counci I. (b) That a notice duly executed in the name of the City of San Marcos, Texas, of the enactment of said above des6ribed ordinance has heretofore been filed with the County Clerk of Hays County, Texas, the County in which said City of San Marcos is situated on the 4th day of June, 1973. (c) Tha~said City Council after having advertised for bids in the manner as required by law and by the Charter of said City, did award the contract for the construction ~f said improvements to Chaney ~onstruction Company upon its~owest and best bid therefor, namely $182,898.50, and said contract, which is dated July 9, 1973, has been executed by said Chaney Construction Company and by the City of San Marcos; and the performance bond required by law and by said contract has been properly furnished by the said Chaney Construction Company. I (d) That the City Council caused the engineering firm of Lockwood, Andrews and Newnam to prepare and file estimates of the costs of such improvements and estimates of the amount per front foot proposed to be assessed aga i nst the property aubtt i ng each of sa i d streets within the I imits defined, and against the real and true owners thereof. (e) That upon the fil ing of said estimates the City Council did by resolution duly enacted on June 13, 1973, provide for and order a hearing to be held at 7:30 o'clock p.m. on the 9th day of July, 1973,
