• ORDINANCE NO. 2008-30 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 86, ARTICLE 3, OF THE <br />SAN MARCOS CITY CODE; ESTABLISHING REGULATIONS <br />GOVERNING THE DISCHARGE OF FATS, OILS AND GREASE <br />INTO THE CITY'S SANITARY SEWER SYSTEM; ESTABLISHING <br />PENALTIES FOR THE VIOLATION THEREOF; PROVIDING FOR <br />PUBLICATION; AND PROVIDING AN EFFECTIVE DATE <br />RECITALS: <br />1. The City operates and maintains a sanitary sewer system to control <br />detrimental discharges into the environment for the health, safety and welfare of its <br />residents. <br />2. Deposits of fat, oil and grease from restaurants and other non-domestic <br />users accumulate in the pipelines and facilities comprising the sanitary sewer system <br />resulting in blockages that cause sanitary sewer overflows. <br />3. Such blockages increase the amount of financial and personnel resources <br />the City of San Marcos must expend to maintain the integrity of its sanitary sewer <br />• system. <br />4. In order to reduce the frequency of sanitary sewer overflows and to reduce <br />the amount of financial and personnel resources expended by the City of San Marcos to <br />maintain the integrity of the sanitary sewer system, it is necessary to establish regulations <br />by ordinance governing the discharge of fats, oils and grease by restaurants and other <br />non-domestic users into the sanitary sewer system. <br />5. For the reasons stated above, the City Council finds and determines that <br />the adoption of this ordinance is in the interest of the health, safety and welfare of the <br />public. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />SECTION 1. Chapter 86, Utilities, Article 3, Sewers, of the San Marco City <br />Code is hereby amended by amending Division 3 and adding a new Division 4, each to <br />read as follows: (underlining indicates added text; ever-st-Fike indicates deleted text): <br />DIVISION 3.
