English and Claire B. English, husband and <br />wife, are the owners of a tract of land containing 49.544 acres, <br />more or less, and a thirty foot (30') easement and right-of- <br />way appurtenant to and running with said tract of land, situated <br />in Hays County, Texas, and conveyed and described in deed from <br />Bertram E. Beecroft and Elizabeth P. Beecroft to John F. English <br />and Claire B. English, dated the day of , <br />1973, and recorded in Volume , Pages , of <br />the Deed Records of Hays County, Texas, which deed, and its <br />record in the public records of Hays County, Texas, is expressly <br />incorporated by reference for all relevant purposes. <br /> <br />John F. English and wife, Claire B. EngliSh, desire <br />an easement fifty feet (50') in width, adjacent to said 3D' <br />wide easement described in the above described deed from Bertram <br />E. Beecroft and wife, for a total easement width of eighty feet <br />(80') to enable access between the two (2) portions of said <br />49.544 acre tract. <br /> <br />NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: <br /> <br />THAT the City of San Marcos, a municipal corporation <br />in San Marcos, Hays County, Texas, for and in consideration of <br />the sum of One and NO/IOO Dollar ($1.00) and other good, <br />valuable and sufficient consideration paid by John F. English <br />and wife, Claire B. English, the receipt of which consideration <br />is hereby acknowledged, has GRANTED, SOLD AND CONVEYED and by <br />these presents does hereby GRANT, SELL AND CONVEY unto the said <br />John F. English and Claire B. English, an easement, 50' in <br />width being more particularly described by metes and bounds as <br />follows: <br /> <br />A 50 foot wide roadway easement out of the J. M. Vere- <br />mendi Survey No. One and within that tract of 5.313 acres of land <br />conveyed to the City of San Marcos by deed by Mamie Puls, et al, <br />dated September 28, 1957 and recorded in Volume 172, Pages 142-143 <br />of the Hays County Deed Records, said 50 foot easement lies <br />generally between the most southerly Southeast line of Airport <br />SUbdivision as recorded in Volume 163, Pages 161-164 and a certain <br />30 foot wide roadway easement, and is more particularly described <br />as follows: <br /> <br />BEGINNING at a point for the most easterly West corner <br />of this 50 foot easement, same bearing S 450 18 W 108.10 feet <br />from an iron pipe found on the most southerly Southeast line of <br />said Airport Subdivision, said iron pipe bears S 450 18 W 898.29 <br />feet from the Southeast corner of said Airport Subdivision; <br /> <br />THENCE N 450 18 E with the most southerly Southeast <br />line of the said subdivision 67.57 feet more or less to the most <br />easterly West corner of the said 30 foot easement; <br /> <br />THENCE with the common line of this easement and the <br />said 30 foot easement the following courses: <br /> <br />S 20 26 E 542.04 feet, <br />S 420 34 W 292.22 feet, <br />N 440 41 W 415.07 feet to a point on the most southerly <br />Southeast line of Airport Subdivision; <br /> <br />- 1 - <br />
