English, husband and wife, are the owners of a tract of land containing 49.544 acres, more or less, and a thirty foot (30') easement and right-of- way appurtenant to and running with said tract of land, situated in Hays County, Texas, and conveyed and described in deed from Bertram E. Beecroft and Elizabeth P. Beecroft to John F. English and Claire B. English, dated the day of , 1973, and recorded in Volume , Pages , of the Deed Records of Hays County, Texas, which deed, and its record in the public records of Hays County, Texas, is expressly incorporated by reference for all relevant purposes. John F. English and wife, Claire B. EngliSh, desire an easement fifty feet (50') in width, adjacent to said 3D' wide easement described in the above described deed from Bertram E. Beecroft and wife, for a total easement width of eighty feet (80') to enable access between the two (2) portions of said 49.544 acre tract. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: THAT the City of San Marcos, a municipal corporation in San Marcos, Hays County, Texas, for and in consideration of the sum of One and NO/IOO Dollar ($1.00) and other good, valuable and sufficient consideration paid by John F. English and wife, Claire B. English, the receipt of which consideration is hereby acknowledged, has GRANTED, SOLD AND CONVEYED and by these presents does hereby GRANT, SELL AND CONVEY unto the said John F. English and Claire B. English, an easement, 50' in width being more particularly described by metes and bounds as follows: A 50 foot wide roadway easement out of the J. M. Vere- mendi Survey No. One and within that tract of 5.313 acres of land conveyed to the City of San Marcos by deed by Mamie Puls, et al, dated September 28, 1957 and recorded in Volume 172, Pages 142-143 of the Hays County Deed Records, said 50 foot easement lies generally between the most southerly Southeast line of Airport SUbdivision as recorded in Volume 163, Pages 161-164 and a certain 30 foot wide roadway easement, and is more particularly described as follows: BEGINNING at a point for the most easterly West corner of this 50 foot easement, same bearing S 450 18 W 108.10 feet from an iron pipe found on the most southerly Southeast line of said Airport Subdivision, said iron pipe bears S 450 18 W 898.29 feet from the Southeast corner of said Airport Subdivision; THENCE N 450 18 E with the most southerly Southeast line of the said subdivision 67.57 feet more or less to the most easterly West corner of the said 30 foot easement; THENCE with the common line of this easement and the said 30 foot easement the following courses: S 20 26 E 542.04 feet, S 420 34 W 292.22 feet, N 440 41 W 415.07 feet to a point on the most southerly Southeast line of Airport Subdivision; - 1 -
