<br />I <br /> <br />I <br /> <br />I <br /> <br />20. <br /> <br />ORDINANCE NO. ] 971 - <;6 <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE <br />5 (TRAFFIC CONTROL DEVICES) OF CHAPTER 29 OF THE CODE OF THE <br />CITY OF SAN MARCOS, TEXAS BY ADDING A PROHIBITION AGAINST RIGHT <br />TURNS ON RED AT THE INTERSECTION OF SOUTH L.B.J. DRIVE AND <br />SAN ANTONIO STREET AND AT THE INTERSECTION OF NORTH L.B.J. DRIVE <br />AND COLORADO STREET WITHIN THE CORPORATE LIMITS OF THE CITY OF <br />SAN MARCOS; PROVIDING FOR A PENALTY; AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the City Traffic Signalization Teehnieian of the <br /> <br />City of San Mareos has requested an ordinance providing for <br /> <br />no right turn on red signs at the intersection of San Antonio <br /> <br />Street and South L.B.J. Drive and at the intersection of North <br /> <br />L.B.J. Drive and Colorado Street. <br /> <br />WHEREAS, the City Council of San Marcos, Texas is of the <br /> <br />opinion that such amendments should be in the best interest <br /> <br />of public safety and welfare of the City of San Marcos; now <br /> <br />therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Part 1: <br /> <br />That pursuant to Section 29-110 and Section 29-110.1 <br /> <br />of the City Code of the City of San Marcos, the City Council <br /> <br />of the City of San Marcos does hereby amend the City Code by <br /> <br />adding a prohibition to Chapter 29 thereof against right turn <br /> <br />on red at the intersection of San Antonio Street and South L.B.J. <br /> <br />Drive and at the intersection of North L.B.J. Drive and Colorado <br /> <br />STreet. <br /> <br />Part 2: <br /> <br />That the Traffic Signalization Technician of the <br /> <br />City of San Marcos is hereby authorized and commanded to erect, <br /> <br />at the intersection of San Antonio Street and South L.B.J. Drive <br /> <br />and at the intersection of North L.B.J. Drive and Colorado Street <br /> <br />within the City of San Marcos, a sign directing all traffic that <br /> <br />right turn on red is not permitted at those intersections. <br /> <br />Part 3: <br /> <br />That any person, firm, or corporation violating any <br /> <br />provision of this chapter shall be deemed guilty of a miSdemeanor, <br /> <br />and on confirmation of same, shall be punished by a fine of not <br /> <br />more than $200.00. Each such violation which shall continue to <br /> <br />be permitted shall be deemed a separate offense. <br /> <br />Part. 4: <br /> <br />That the City Council hereby finds that an emergency <br /> <br />exists requiring the suspension of the rule provided by the C~ty <br /> <br />Chapter requiring ordinances to be read on three separate days <br />
