WHEREAS, the bid of Ascencion Esquivel was opened by said <br />City on January 23, 1981, and was duly determined the highest <br />and best responsible bid for said property; and, <br /> <br /> WHEREAS, the bid by Ascencion Esquivel is sufficient to <br />pay the delinquent taxes, penalty, interest and court costs <br />due on said property and the legal actions pursuant thereto; <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br /> SECTION 1. That the bid of Ascencion Esquivel in the <br />amount of one thousand five hundred dollars ($1,500.00) for <br />a portion of that tract of land conveyed to Felipe DeLeon <br />by J.F. Parsons and Lawrence R. Parsons, Jr., by deed dated <br />December 5, 1945 and recorded in Volume 133, Pages 315-316, <br />Hays County Deed Records, said portion described more particularly <br />by metes and bounds as follows: <br /> <br />Beginning at the south corner of the compress <br />property in San Marcos, Hays County, Texas, as <br />the same is located in a deed dated July 1, 1943, <br />from E.M. Cape and Clara Louise Cape to J.R. <br />Wallace, which said deed is now of record in the <br />deed record~ of Hays County, Texas, in Vol. 127, <br />at pages 399-400, and the said deed with the said <br />record of the same are here referred to and made <br />part hereof for all pertinent purposes for loca- <br />tion of the said south corner of said compress <br />property; <br /> <br />Thence N. 46° -4' W. 48 feet to a point for corner <br />.which said corner is the east and beginning corner <br />of the tract of land hereby conveyed; <br /> <br />Thence S. 43° 045' W. 108.7 feet to a point for <br />corner which said corner is the south corner of <br />the tract of land hereby conveyed; <br /> <br />Thence N. 45~ -20' W. 25 feet to a point for corner <br />which said corner is the west corner of that tract <br />of land hereby conveyed; <br /> <br />Thence N. 43° -45' E. 108.3' feet to a point for <br />corner, which said corner is the north corner <br />of the tract of land hereby conveyed, said mentioned <br />corner being also in the northwest boundary line <br />of the above mentioned compress property, <br /> <br />Thence S. 46° -4' E. 25 feet along the said north- <br />west boundary line of the said compress property <br />to the point of beginning being the above mentioned <br />east corner of the said tract of land hereby conveyed <br /> <br />be, and the same is hereby accepted as the highest and best <br />responsible bid for said property. <br /> <br /> SECTION 2. That the Mayor Pro Tempore of said City, John <br />J. Stokes, be, and he is hereby, authorized to execute a special <br />warranty deed to Ascencion Esquivel for said property on behalf <br />of the City of San Marcos, in trust for itself, the State of <br />Texas, the County of Hays and the San Marcos Consol~dated <br />Independent School District. <br /> <br /> SECTION 3. That the importance of this Ordinance creates <br />an emergency and an imperative purpose necessary that the pro- <br />visions of the charter requiring that ordinances shall be read <br /> <br /> <br />
