<br />J <br /> <br />I <br /> <br />I <br /> <br />/31 <br /> <br />STATE OF TEXAS X <br />X <br />CITY OF SAN MARCOS X <br /> <br />THIS AGREEMENT MADE AND ENTERED INTO on this the 12th day <br /> <br />of June, 1972, by and between the City of ~an Marcos, a political <br />subdivision of the State of Texas, acting by and through its Mayor, <br /> <br />hereinafter called Lessor, and Jon Mostyn, of San Marcos, Texas, <br /> <br />hereinafter called Lessee. <br /> <br />1. In consideration of One Hundred Dollars ($100.00) paid <br /> <br />by Lessee to Lessor, receipt of which is hereby acknowledged by <br /> <br />Lessor, said Lessor does hereby lease to said Lessee a part of <br /> <br />the 4.83 acre tract of land located at the North end of the north- <br /> <br />south runway of Lowman Airport with the right of ingress to and <br /> <br />egress from the same, for the purpose of erecting and maintaining <br /> <br />an advertising bulletin or billboard thereon, from the 12th day <br /> <br />o~ June, 1972, to the 12th day of June 1973. <br /> <br />2. Lessee shall have the privilege to request a renewal of <br /> <br />this lease for a like period upon like terms and conditions, at <br /> <br />the end of the term hereof; provided he shall give written notice <br /> <br />to Lessor at any time within thirty (30) days prior to the expi- <br /> <br />ration of the term hereof of his election to exercise such option, <br /> <br />such notice to be delivered to Lessor by registered or certified <br /> <br />mail, to the City Hall in San Marcos, Texas. However, Lessor <br /> <br />shall have the right to refuse to renew this lease for a like <br /> <br />period upon like terms and conditions and, if it does so refuse, <br />notice of such refusal shall be delivered within ten (10) days <br /> <br />of its receipt of Lessee's notice, by registered or Certified <br /> <br />mail, to Lessee at the following address: P.O. Box 1369, San <br /> <br />Marcos, Texas. <br /> <br />3. It is expressly agreed that Lessor may terminate this <br /> <br />, <br />lease by giving Lessee thirty (30) days notice by registered <br /> <br />or certified mail, delivered to the above address and refunding <br /> <br />to Lessee a prorata portion of said $100.00. <br />
