J I I /31 STATE OF TEXAS X X CITY OF SAN MARCOS X THIS AGREEMENT MADE AND ENTERED INTO on this the 12th day of June, 1972, by and between the City of ~an Marcos, a political subdivision of the State of Texas, acting by and through its Mayor, hereinafter called Lessor, and Jon Mostyn, of San Marcos, Texas, hereinafter called Lessee. 1. In consideration of One Hundred Dollars ($100.00) paid by Lessee to Lessor, receipt of which is hereby acknowledged by Lessor, said Lessor does hereby lease to said Lessee a part of the 4.83 acre tract of land located at the North end of the north- south runway of Lowman Airport with the right of ingress to and egress from the same, for the purpose of erecting and maintaining an advertising bulletin or billboard thereon, from the 12th day o~ June, 1972, to the 12th day of June 1973. 2. Lessee shall have the privilege to request a renewal of this lease for a like period upon like terms and conditions, at the end of the term hereof; provided he shall give written notice to Lessor at any time within thirty (30) days prior to the expi- ration of the term hereof of his election to exercise such option, such notice to be delivered to Lessor by registered or certified mail, to the City Hall in San Marcos, Texas. However, Lessor shall have the right to refuse to renew this lease for a like period upon like terms and conditions and, if it does so refuse, notice of such refusal shall be delivered within ten (10) days of its receipt of Lessee's notice, by registered or Certified mail, to Lessee at the following address: P.O. Box 1369, San Marcos, Texas. 3. It is expressly agreed that Lessor may terminate this , lease by giving Lessee thirty (30) days notice by registered or certified mail, delivered to the above address and refunding to Lessee a prorata portion of said $100.00.
