<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, APPROVING FINAL PAYMENT
<br />TO DU-MOR ENTERPRISES FOR CONSTRUCTION OF
<br />IMPROVEMENTS TO THE CITY OF SAN MARCOS KNOWN
<br />AS THE VICTORY GARDENS PHASE II PROJECT; ACCEPT-
<br />ING SAID IMPROVEMENTS FOR USE BY SAID CITY; AU-
<br />THORIZING PAYMENT IN THE AMOUNT OF ONE HUNDRED
<br />TWO THOUSAND SEVEN HUNDRED THIRTY EIGHT DOLLARS
<br />AND NINETY TWO CENTS ($102,738.92) TO DU-MOR
<br />ENTERPRISES AND DECLARING AN EFFECTIVE DATE.
<br />
<br /> WHEREAS, the City of San Marcos, Texas, contracted with Du-
<br />Mor Enterprises, of San Antonio, Texas, on July 30, 1980, for
<br />the construction of improvements to Camacho Street, Hull Street,
<br />MacArthur Street, Railroad Street, Grove Street, Alabama Street
<br />and Armstronng Street in the City of San Marcos, said improve-
<br />ments to consist of water distribution, paving and drainage and
<br />to be known as the Victory Gardens Phase II Project (HUD Commun-
<br />ity Development Block Grant 9B-79-DS-48-0508); and,
<br />
<br /> WHEREAS, Beeline Engineering, of San Marcos, Texas, was
<br />retained by the City of San Marcos on April 21, 1980, to provide
<br />engineering services in connection with said Project; and,
<br />
<br /> WHEREAS, the Victory Gardens Phase II Project has been com-
<br />pleted and final inspection was held on May 22, 1981; and,
<br />
<br /> WHEREAS, R.V. Kotowski, of Beeline Enterprises, has found
<br />the constructin to be complete and in general conformance with
<br />the contract documents with the following exceptions:
<br />
<br />1) A stop sign must be replaced at the intersec-
<br /> tion of Guadalupe and Armstrong Streets.
<br />2) A valve box must be covered at the intersec-
<br /> tion of Hull and Camacho Streets.
<br />3) Four (4) inlet tops (not installed) must be
<br /> delivered to the City; and,
<br />
<br /> WHEREAS, City Manager A.C. Gonzalez recommends final accep-
<br />tance of Victory Gardens Phase II improvments for use by the
<br />City of San Marcos as of May 22, 1981; now, therefore,
<br />
<br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br />
<br /> PART 1. That the construction of water distribution, pav-
<br />ing and drainage improvements to Camacho Street, Hull Street,
<br />MacArthur Street, Railroad Street, Grove Street, Alabama Street,
<br />and Armstrong Street, known as the Victory Gardens Phase II
<br />Project (HUD Community Developmment Block Grant 9B-79-DS-48-0508),
<br />by Du-Mor Enterprises of San Antonio, Texas, be, and they
<br />are hereby, accepted as complete pursuant to the terms of the
<br />contract of July 30, 1980 between the City of San Marcos and
<br />Du-Mor Enterprises, with the exceptions noted in Part 2.
<br />
<br /> PART 2. That payment to Du-Mor Enterprises, of San Antonio,
<br />Texas, in the amount of ONE HUNDRED TWO THOUSAND SEVEN HUNDRED
<br />THRITY EIGHT DOLLARS AND NINETY TWO CENTS ($102,738.92) be, and
<br />the same is hereby, approved upon submission to the Department
<br />of Finance by Beeline Enterprises of a statement that the f611ow-
<br />ing actions have been taken by Du-Mor Enterprises:
<br />
